No. 01/2020 in WP. No. 17441/2020 and dismiss the writ petition. pending disposal of WP No. 17441 of 2020, on the file of the High Court. The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following order.(The receipt of this order will be deemed to be the receipt of notice in the case). The Court made the following ORDER:
"The petitioners in I.A.No.2 of 2020 is the Government against whom the petitioners in I.A.No.1 of 2020 obtained an interim suspension of proceedings, dated 15.09.2020 by order dated 28.09.2020.
The petitioners in I.A.No.2 of 2020 requested to vacate the interim direction issued by this Court on 28.09.2020 on the ground that the petitioners did not challenge the rules. However, at this stage, on that ground the interim order dated 28.09.2020 cannot be set aside. However, it is made clear that the direction is only limited to suspension of the proceedings, dated 15.09.2020 issued by the 3" respondent to the Notification No.1/40, | dated 10.01.2020.
In fact, the said notification was issued specifying the qualifications for appointment of Village Horticulture Assistant (VHA). By that time, no service rules were framed for appointment of Village Horticulture Assistant (VHA), but for different reasons, a notification by corrigendum was issued on 30.01.2020, examinations were held on 25.09.2020 and final selection was completed in the month of November, 2020, but the results of the petitioners in I.A.No.1 of 2020 were not declared while declaring the result of other candidates appeared for the examinations, However, the notification issued by way of corrigendum was withdrawn by order dated 15.09.2020, but by the interim order dated 28.09.2020, the proceedings, dated 15.09.2020 is suspended.
-2- Therefore, the petitioners in I.A.No.2 of 2020 did not declare the results of the petitioners in I.A.No.1 of 2020 as the impugned petition is pending while releasing the result of other candidates. But, the effect of the order of suspension is not for declaring the result of the petitioner.
However, no direction was issued by this Court in the order dated 28.09.2020 directing the petitioners in I.A.No.2 of 2020 but declared the results of the petitioners in LA.No.1 of 2020. Thus, even if the interim order continues to subsist this will not amounts to direction to the petitioners/Government to declare the results of the petitioners in
1.A.No.1 of 2020.
Therefore, there is absolutely no ground to vacate interim order as on date and the said order will have no effect. However, the eligibility of the petitioners and legality of the corrigendum and its cancellation by order dated 15.09.2020 shall be decided only in the writ petition. But, for the present, the interim order cannot be disturbed as the said order is limited only for interim suspension of the proceedings, dated 15.09.2020. With the above clarification, the interim order, dated 28.09.2020 is made absolute. However, both the counsels are requested to get ready in the impugned petition, as early as possible.
