Notice to the 4th respondent. Sri S. Sriram, learned Advocate General appearing for the petitioner states that he filed reply (rejoinder) to the counter filed by the 1st respondent.

Heard all the counsel.

We have considered the facts and circumstances of the case, submissions of the counsel and perused the record and prima facie, found that the 1st respondent/applicant promoted as Assistant Conservator of Forests (for short "ACF") in August, 2020, as he is not having the required length of eight years of service in the ACF post, to include his name in the panel for the purpose of promotion/conferment of Indian Forest Service, then he filed Original Application 2 before the Central Administrative Tribunal, Hyderabad to declare that the post of Forest Range Officer is also eligible to be included in the panel and consider his case for inclusion by taking his service as Forest Range Officer. The Tribunal on erroneous appreciation of rules allowed the Original Application, by declaring that the post of Forest Range Officer is eligible to be included in the panel. The impugned order has far reaching consequences and the post of Forest Range Officer is not approved by the Central Government as required under Rule 2(g) of the Indian Forest Service (Recruitment) Rules, 1966 and hence, the cases of Forest Range Officers are not entitled to be included in the panel for the purpose of promotion/conferment of Indian Forest Service. The issues raised in these writ petitions needs to be adjudicated finally.

Pending adjudication of the issues, there shall be an interim suspension of the impugned order passed by the Central Administrative Tribunal, Hyderabad in OA.No.020/00628/2021dated 12.04.2022.
