ORDER
1. The Appellant filed an RTI application dated 28.04.2024 seeking information on the following points:
1. मुझे मेरे फोन नंबर ******1954 और नाम राम अवतार और पता आई सैकंड 94 मिननगर नई दिल्ली 110062 के आधारानुसार की गई 100 नंबर कालो की वाइस ररकॉर्डिंग प्रिान की जाए जो 11,15,19,21,27 अप्रैल महीने की साल 2024 Page 1 of 7 की नवनिन्न नवनिन्न तारीखों पर की गई थी। ट्ांसदिप्शन नववरण सनहत उपलब्ध करवाए सिी कालो की।
2. दिनांक 11 अप्रैल 2024 की िोपहर 12 बजे से लेकर 27 अप्रैल रात बारह बजे तक की अंबेडकर नगर थाना दिल्ली 110062 के थाने की कै मरे की ररकॉर्डिंग प्रिान करे जो मुख्य गेट से सिी आने जाने वालों की ररकॉर्डिंग करता है।
3. 11,19,20 अप्रैल को मेरे और मेरे जमानती के सिी पेपर जो आई ओ नगरी साहब और आई ओ सुनील निवेिी साहब और एस एच ओ साहब िारा तैयार दकए गए या करवाए गए है उन सब की कॉपीज सप्लाई करे और इन तीनो डेट्स और उपर सीररयल नंबर 1 मैं वर्णगत कालो के अनुसार जो िी पेपसग तैयार दकए गए उन सब की copies सप्लाई करे । चाहे वह हाथ की नलखी हुई हो और चाहे दकसी मशीन से छपाई के माध्यम से तैयार की गई हो।
4. नजस िस्तावेज, जवाब, वाइस ररकॉर्डिंग, वीनडयो ररकॉर्डिंग, सलाह,आिेश, वातागलाप, कं सीडरे शन इत्यादि यदि कोई और िी हो या कोई अन्द्य प्रकार की िी हो तो के आधार पर जो आई पी सी 182 का मुकिमा जो मेरे नखलाफ बनाया गया है या बनवाया गया है उन सिी को जो इस सीररयल नो 4 मैं वर्णगत है के अनुसार मुझे उपलब्ध करवाया जाए।
5. दिनांक 10 अप्रैल 2024 को जो साहब पते आई सैकंड 94 मिनगीर नई दिल्ली 110062 पर जांच करने को आए अंबेडकर नगर थाने से बगैर विी के , नजन पेपसग को लेकर के आए जो हमारे नसलनसले मैं थे नजनके आधार पर जांच होनी थी उन पेपसग की कॉपीज िी जाए और साथ मैं उन अनधकारी साहब का नाम और मोबाइल नंबर िी बताया जाए। और उनकी कॉल नडटेल जब जब उन्द्होंने कायगवानहयां करी नशकायत के संबंध मैं या मेरे अलावा दकन्द्ही अन्द्य से नमले हो Page 2 of 7 नशकायत के संबंध मैं जांच करने हेतु। या दकसी अन्द्य प्रकार से उनके घरों पर जांच की हो मेरे अलावा कृ पया नलनखत िस्तावेज उपलब्ध करवाए। ..., etc./ other related information
2. The CPIO replied vide letter dated 16.05.2024 & 05.06.2024 and the same is reproduced as under :-
Reply dated 16.05.2024 "केन्द्रीय पुलिस लियंत्रण कक्ष ERSS -100/112 में मोबाइि िंबर *****1954 से लििां क 11,15,19,21,27.04.2024 को (05) कॉि प्राप्त हुई। बाकी की जािकारी कॉि फॉमम में है , जो की स्व-वलणमत हैं जो की इस कायाम िय में उपिब्ध है । उपरोक्त कॉिों की ऑलियो ररकॉलििं ग इस कायामिय में उपिब्ध है । शे ष सूचिा का सम्बंध जि सूचिा अलधकारी/िलक्षण लजिा, लिल्ली से संबलधत है तथा आपका आवेिि जि सूचिा अलधकारी/िलक्षण लजिा, लिल्ली को पहिे ही पुलिस मुख्यािय द्वारा भेजा जा चूका है ।"
आप उपरोक्त (05) पीसीआर कॉि फॉमम (कुि प्रष्ठ-10) व एक (01) CD इस कायाम िय के आर.टी.आई सैि, जो पुलिस लियंत्रण कक्ष, एम.एस.ओ. लबल्डं ग, छठा ति, आई.पी. स्टे ट, िई लिल्ली-110002 में ल्ित है , से िो रुपये प्रलत पेज व पचास रुपये प्रलत CD (कुि 70/- रुपये) केश, बैंक िर ाफ्ट, और चेक के द्वारा DCP/PCR के पक्ष जमा करके लकसी भी कायम लिवस में 11 AM से 4 PM के बीच में 30 लििों के अंिर, अपिा आई िी प्रूफ लिखाकर, प्राप्त कर सकते हैं ।
Reply dated 05.06.2024 "1. आपका आरटीआई आवेिि पत्र पुलिस मुख्यािय द्वारा पहिे ही पुलिस कंटर ोि रूम को िािां तररत लकया जा चुका है , जो आपको ज़बाब प्रिाि करें गे।
2-6 & 8. इस संिभम मे आपको सूलचत लकया जाता है लक सू चिा सहायक आयुक्त पुलिस/लचतरं जि पाकम उपखंि, िलक्षणी लजिा िई लिल्ली से प्राप्त ररपोटम के अिुसार आपकी लशकायत थािा अंबेिकर िगर मे SI सुिीि चन्द्रा के पास जााँच हे तु िं लभत है Page 3 of 7
7. संबल्ित थािे के उच्च अलधकारी को।"
3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 08.06.2024 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 04.07.2024 stated as under: -
"अपीिाथी के आवेिि पत्र, अपीि एं व जि सूचिा अलधकारी, पुलिस लियंत्रण कक्ष, लिल्ली के द्वारा अपीिाथी को भे जे गये जवाब का अध्ययि करिे के पश्चात् यह ज्ञात होता हैं लक जि सुचिा अलधकारी, पुलिस लियंत्रण कक्ष, लिल्ली द्वारा आई.िी. संख्या-संख्या- 1243/2024/2268/जि सूचिा प्र०/पु०लि०क० लििां क 16.05.2024, से अपीिाथी को उपिब्ध जबाब लिधाम ररत समय से भेजा जा चुका हैं । लफर भी आपको पुिः अवगत कराया जाता है लक 15/04/2024 को केन्द्रीय पुलिस लियंत्रण कक्ष लिल्ली मे मोबाईि िं ******1954 से एक (01) काि प्राप्त हुई थी जो काि प्राप्त होिे के तु रन्त बाि ही Disconnect हो गई थी। इस संबंध मे उपिब्ध काि फामम स्व. व्याख्यात्मक है लजसकी प्रलतलिपी आपको भेजी जा रही है । इसके अलतररक्त शे ष सूचिा का सम्बि प्रथम अपीिीय अलधकारी/िलक्षण लजिा, लिल्ली पुलिस, लिल्ली से सम्बंलधत है। इसलिए आपकी प्रथम अपीि व RTI आवेिि को प्रथम अपीिीय अलधकारी/िलक्षण लजिा, लिल्ली पुलिस, लिल्ली को आवश्यक कायमवाही हे तु अग्रे लसत लकया जा रहा हैं । इसके अलतररक्त इस आवेिि-पत्र से सम्बंलधत इस इकाई में कुछ भी िं लबत िहीं है ।"
4. Aggrieved with the FAA's order, the Appellant approached the Commission with the instant Second Appeal dated 09.10.2024.
5. The appellant and on behalf of the respondent Suman Bisht, Inspector, attended the hearing in person.
6. The appellant inter alia submitted that although the CPIO had initially admitted that audio transcription was available under their custody, the same was subsequently denied to him. He insisted that complete information may be provided to him, at the earliest.

The respondent while defending their case inter alia endorsed their reply dated 05.07.2024 and stated that Ambedkar Nagar Police Station was true custodian of the information in relation to which the instant RTI application was sought, and the point- wise information provided by them is extracted below:
"1. No voice recording is available at this Police Station. Hence, information may be obtained from higher authority/concerned unit.
2. CCTV recording could not be provided as it contains sensitive information related to Police Station.
3. A Kalandara vide GD No. 71A, dated 20.04.2024 U/S 182 IPC has been prepared against the applicant Ram Avtar by SI Sunil Chandra and submitted before the Saket Court. Applicant will collect copy of the Kalandra from Room No. 216, Saket Court..
4. In view of point no. 3
5. In view of point no. 3
6. It does not relate to this Police Station.
8. As per record on 10.04.2024, no PCR Call from Mobile No. xxxxxx954 or any complaint on the name of applicant was found received at this police station. Hence, information may be treated as nil. Moreover, CDR details of the investigation/enquiry officers could not be provided."

The Commission after adverting to the facts and circumstances of the case, hearing both parties and perusal of records, observes that the replies given by the respondent are ambiguous and self-contradictory. The reply provided by the Ambedkar Nagar Police Station on 05.07.2024 is partly appropriate. In this regard, the CPIO having confirmed that the recording sought in the RTI application was not available in their Police Station, there appears to be no infirmity with the reply given thereof. Further, the appellant's Page 5 of 7 attention is drawn towards the decision passed in CBSE & Anr. vs. Aditya Bandopadhyay & ors. (C.A. No. 6454 of 2011) wherein the following was held:
"35. ...But where the information sought is not a part of the record of a public authority, and where such information is not required to be maintained under any law or the rules or regulations of the public authority, the Act does not cast an obligation upon the public authority, to collect or collate such non-available information and then furnish it to an applicant..."
However, the reply given against point no. 2 of the RTI application is insufficient since the CPIO has not claimed proper exemption laid down under Section8 or 9 of the RTI Act, while denying the sought information.
8.1. Further, the information given in respect of point no. 1 of the RTI application initially on 16.05.2024, wherein the CPIO admitted that the audio transcriptions of the appellant's calls were available under their custody, it is noted that the same was not divulged despite a clear RTI request for the same. In view of the above, the respondent is directed to provide revised information against point no. 1 of the RTI application & a clear reply against point no. 2 of the RTI application, as per provisions of the RTI Act to the appellant, within 15 days from the date of receipt of this order, under due intimation to the Commission. Accordingly, the appeal is disposed of.
Copy of the decision be provided free of cost to the parties.
