1. Appellant Shri. Arun Sundamrao Modale as well as his counsel Shri. Virendra T.Sakolkar are absent. None for the respondent is present. Adv. Shri.N.P.Patil for the respondent No. 1 is also absent. On last date as well as on earlier date the appellant as well as his respondent were absent. However, on last date the matter was adjourned till today by way of last chance but today also nobody for the appellant as well as respondent are present. Therefore there is no alternative except to dismiss the appeal.
2. However, we have gone through the copy of the impugned judgment and order and we find that the impugned judgment and order is just, proper and legal. Hence the appeal is dismissed. No order as to cost.
