Heard Shri Ajesh Luthra with Mrs. Kamlakshi Singh, the learned counsel for the applicants.
O.A.No.954/201611
2. M.A.No.928/2016, filed under Rule 4(5)(a) of the CAT (Procedure) Rules, 1987 seeking to file a single OA, in the circumstances, is allowed.
3. The applicants, who are presently working as contractual Teachers under the Respondent-Govt. of NCTD, filed the OA seeking the following relief(s):
"(a) Not to substitute or replace the applicants by another set of contractual employees.
(b) Not to give break of two months in vacation and pay salary and allowances for the said period, till the applicants continue in service.
(c) any other relief which this Hon'ble Tribunal deems fit."
4. The applicants have also prayed for Interim Relief as under:
"In view of the above, it is, therefore, most respectfully prayed that the Hon'ble Tribunal may kindly be pleased to direct the respondents not to terminate the services of the applicants, till the pendency of the OA."

It is the case of the applicants that though they are working as contractual Teachers as on today but they are apprehending that their services will be terminated at the end of this month as the academic year, i.e., 2015-2016, is coming to an end and also as per the earlier practice of the respondents and that they may be replaced with another set of contractual Teachers in the next academic year, i.e., 2016-2017. However, the applicants failed to show any document, such as fresh notification calling for applications, etc., to the affect that the respondents are contemplating to replace the applicants with another set of contractual Teachers. Since as on today neither the services of the applicants are terminated nor the respondents O.A.No.954/2016 12 contemplated any action to replace them with another set of contractual Teachers, there is no subsisting cause of action for this OA and accordingly the same is premature.
6. Further, the other relief/direction sought by the applicants is that not to give break of two months in vacation and to pay salary and allowances for the said period, is also equally premature as the vacation does commence as on today and the salary for the vacation period falls due.
7. In view of our above finding, the decision in Rattan Lal & Others, etc. v. State of Haryana & Others, (1985) 4 SCC 43, on which the learned counsel for the applicants placed reliance, would not help the applicants.
8. In the circumstances and for the aforesaid reasons the OA is dismissed as premature. However, the applicants are at liberty, if any cause of action arises in future, to avail the remedies, in accordance with law. No costs.
