1. The present petition has been filed under Section 482 Cr.P.C. for quashing of FIR No.326, dated 18.12.2015, under Sections 406, 420, 467, 468, 506, 120-B of IPC, registered at Police Station City Khana and the order dated 06.07.2018 passed by the learned Judicial Magistrate Ist Class, Khanna whereby the petitioner's son was declared proclaimed offender.

2. After arguing for some time, learned counsel for the petitioner fairly submits that the petitioner is presently at abroad and is keen to return back to India and face the proceedings. He submits that the apprehension of the petitioner is regarding his arrest as he has already been declared a proclaimed offender. He submits that the petitioner be granted some protection so as to enable him to appear before the Investigating Agency. He further prays for withdrawal of the present petition by granting some protection to the petitioner from his arrest. He submits that the petitioner would return to India before 15.07.2023.

3. Notice of motion.

4. At the asking of the Court, Mr. Sandeep Kumar, DAG, Punjab appears and accepts notice on behalf of the respondent-State. A copy of the paper book be supplied to him during the course of the day.

6. After hearing learned counsel for the parties and perusing the record, it seems that the prayer made by learned counsel for the petitioner is genuine one.

7. In view of the above submissions, the present petition is disposed of. In case the petitioner returns to India by 15.07.2023 and appears before the concerned Court within 7 days thereafter, he would have a protection from arrest for 10 days from the date of his landing in India. Further, in case he files an application before the concerned Court for the redressal of his grievance, the same would be decided by the said Court expeditiously in accordance with law. Needless to add if the petitioner do not comply with the undertaking given before this Court, interim protection granted today would be of no avail to him.
