The petitioner who is working as Sahayak Adhyapak in Government Girls Higher Secondary School, Niwari, District Tikamgarh has filed this petition seeking regular pay scale in the light of order passed by the Division Bench at Indore of this Court in W.A. No. 346/2008 (Smt. Usha Ranawat vs. State of M.P. and others).
Learned Government Advocate for the respondent/State has pointed out that the petitioner has not filed any representation in this regard before the competent authority who is respondent No.2/District Education Officer, Tikamgarh.
In view of the submissions made by the learned counsel for the parties, this petition is disposed of with a direction to the petitioner to file a representation before the respondent No.2/ District Education Officer, Tikamgarh within a period of 10 days from today, and the respondent No.2/District Education Officer, Tikamgarh, in turn, shall decide the same as per law keeping in view of the order passed in the case of Smt. Usha Ranawat vs. State of M.P. and others within a further period of 30 days. In case the petitioner is found entitled, the benefits may be extended to him, and in case the authority finds that the benefits cannot be extended, a detailed order may be passed in this regard informing the petitioner.
It is made clear that this Court has not opined on the merits of the case.
With the aforesaid direction, this petition stands disposed of. Certified copy as per rules.
