JUDGMENT
The above writ petition is filed challenging Exts.P18 and P23 orders. Petitioners have also sought for other consequential reliefs.
2. Brief facts necessary for the disposal of the writ petition are as follows: Petitioners herein are local residents near to the property having an extent of one acre comprised in resurvey Nos.117/3 and 117/3/3 of Malayattor Village, which is in exclusive possession of the 7 th respondent. The 7th respondent filed an application seeking permission for the construction of a burial ground before the 3rd respondent. Later, as per the direction issued by this Court based on the objection raised by the petitioners Ext.P3 decision was taken by the 2 nd respondent District Collector refusing sanction to construct the proposed burial ground. After Ext.P3 decision, 7th respondent again approached the 3rd respondent for the sanction of construction of a concrete vault cemetery. Thereupon, petitioners again approached this Court filing W.P.(C) No.40723 of 2018 and various representations were also filed. Thereupon, the writ petition was disposed of as per Ext.P7 directing the 2nd respondent to take a decision in accordance with law. Various reports were called for, as evident from W.P.(C) No.30778 of 2021 2026:KER:6849 Exts.P9 to P17 and without considering various reports, a decision was taken in favour of the 7th respondent and sanction was granted for the construction of the vault cemetery. Aggrieved by the same Ext.P19 appeal was preferred and the same was dismissed as per Ext.P23 order. It is aggrieved by the same that the petitioners have approached this Court.

The main contentions raised by the petitioners in this writ petition is that the area where the proposed burial ground is sought to be established is a place where 90% of the people living there belong to the scheduled caste and scheduled tribe community and as per the terms of Ext.P6 patta the land assigned can be used solely for the purpose of agriculture and for no other purpose. The further contention raised by the petitioners is that in Ext.P1 committee report and Ext.P3 order wherein the earlier application was rejected, there is a finding to the effect that there are residential houses at a distance of 11.10 metres and 39 metres respectively and there are four other dwelling houses situated at a distance of 50 to 51 metres from the site proposed for cemetery. The said reports were overlooked while granting permission as per Exts.P18 and P23. Yet another contention raised by the petitioners is that the establishment of a cemetery will result in communal disorder in the area and further it will cause contamination of the water sources. It is further contended that six quarries are functioning in the area and due to the blasting of the quarries there is every chance of causing damage to the cemetery.

A detailed counter affidavit has been filed by the 7 th respondent wherein it is stated that there are about 34 families belong to muslim community and the nearest burial ground is almost 15 kms. away and that the permission was granted after obtaining all necessary permissions and licences including no objection certificate from the District Medical Officer (Ext.R7-A), consent to establish issued by the Kerala State Pollution Control Board (Ext.R7-B), permission from the District Collector (Ext.R7-C), approval from the Senior Town Planner (Ext.R7-D), building permit from the local authority (Ext.R7-E), completion certificate issued by the District Medical Officer (Ext.R7-I) and consent to operate by the Pollution Control Board (Ext.R7-J). The violation of the distance criteria alleged by the petitioners is without any basis. It is submitted that necessary consent and permissions were granted duly taking note of the minimum distance criteria as provided in the Kerala Panchayat Raj (Burial and Burning Grounds) Rules, 1998, and therefore sought for dismissal of the writ petition.
5. I have heard the rival contentions on both sides.

When the matter came up for consideration on 11.03.2022, taking into consideration the grievance raised by the petitioners, this Court directed respondents 12 and 13, ie., the District Disaster Management Authority and the District Geologist, to conduct an inspection and enquiry in the presence of the representatives of respondents 2, 3, 7 W.P.(C) No.30778 of 2021 2026:KER:6849 and 9 and the petitioners and submit a report. Pursuant to the same, a report has been produced along with a memo dated 28.05.2022, wherein the claim of the 1st petitioner regarding the presence of a well was found to be untenable since the same was built only recently. Further, as regards the contention that the property where the burial ground is established is a patta land, the report states that the land has been handed over to the occupiers for cultivation purposes under the Kerala Land Assignment Rules, 1964. It is also reported that there are no dwelling houses within the objectionable distance. A report has also been filed by the Environmental Engineer, Kerala State Pollution Control Board, District Office, Ernakulam, wherein it is stated that cemetery was inspected on 20.01.2022 as per the direction issued by this Court on 05.01.2022 regarding the pollution that may be caused due to seepage of water from the cemetery, wherein also it is reported that the distance from the proposed cemetery to the nearest residences, ie, petitioners' residences is 28 metres. It is further stated that the cemetery is constructed complying with all the conditions issued by the Pollution Control Board and also provided adequate control measures such as concreted cells providing HDPE liners, etc. and that the 7 th respondent has scientifically constructed the vault, providing all control measures and the Board is not expecting any pollution problem in the cemetery. It is also stated that in addition the Board had issued a direction to the 7 th respondent as per Ext.R9(c) to provide a roof to the vaults as an additional control W.P.(C) No.30778 of 2021 2026:KER:6849 measure so that seepage of rainwater to the vault can be prevented.

The contention regarding violation of the distance criteria raised by the petitioners based on Exts.P1 and P3 cannot be made applicable inasmuch as Exts.P1 and P3 were issued considering an application submitted by the 7th respondent for establishing a burial ground, whereas the present application is for the establishment of a vault cemetery. Therefore, the distance from the nearest dwelling house, etc. mentioned in Ext.P3 cannot have any application when the present application is not for establishing a burial ground, but for establishing a vault cemetery. The Kerala Panchayat Raj (Burial and Burning Grounds) Rules, 1998 provides different distance criteria when it comes to burial ground and vault cemetery. Rule 5 of the Kerala Panchayat Raj (Burial and Burning Grounds) Rules, 1998 mandates that burial ground cannot be permitted within 50 metres of any dwelling house or any water source, whereas in the case of concrete cemetery, the distance from the dwelling house need be only 25 metres. In the report submitted pursuant to the order of this Court dated 11.03.2022 also, it is specifically stated that all the houses are located outside the 50 metres and further that there is no well within 25 metres from the vault cemetery proposed and further that one well which is pointed out by the petitioners was dug only recently. I have already held that the distance criteria stipulated on a burial ground which was considered while issuing Ext.P3 order cannot be made applicable to the present application, which is W.P.(C) No.30778 of 2021 2026:KER:6849 an application for construction of a concrete vault cemetery, for which a different distance criteria has been prescribed as per Rule 5 of the Kerala Panchayat Raj (Burial and Burning Grounds) Rules, 1998. As discernible from the counter affidavit filed by the 7 th respondent, they have established the concrete cemetery after obtaining necessary consent from the authorities concerned. Therefore the contention of the petitioners on those counts are rejected.

One of the other contention raised by the petitioners is that the property in which the concrete cemetery is established is a patta land, which has been granted solely for the purpose of undertaking cultivation activities and that a burial ground or a concrete cemetery cannot be established in such a land and the action of the 7th respondent is a clear case of violations of the patta conditions and therefore liable to be interfered with. Though on a perusal of Ext.P23 appellate order, such a contention is seen raised and considered by the Government, there is absolutely no finding to that effect while the appeal was rejected by the Government. Further, it is to be seen that these aspects were directed to be examined by the authorities concerned as per an interim order dated 11.03.2022, pursuant to which a report has been filed. A perusal of the report produced along with memo dated 28.05.2022 reveals that the Tahsildar had called for a report from the Village Officer concerned, wherein it is reported that one hectare of land has been handed over to the then occupiers for cultivation W.P.(C) No.30778 of 2021 2026:KER:6849 purpose under the Kerala Land Assignment Rules, 1964. But the report is also silent as to whether any activity could be undertaken other than agricultural activities in the said patta land and as to whether the establishment of a concrete cemetery is in violation of the patta condition. Petitioners rely on the Division Bench judgment of this Court in Raphy John v. Land Revenue Commissioner, 2022 (3) KLT 679, wherein it is held that when the land is assigned for agricultural operation, no other activity could be undertaken including quarrying activity and further held that the purchaser of an assigned land from the original assignee is also bound by the conditions attached to the original assignment/patta.
Taking into consideration the fact that though a contention was raised before the appellate authority that the land in which the subject concrete cemetery is established is a patta land and the establishment of the cemetery is in violation of the patta conditions, there is no finding to that effect while issuing Ext.P23 order and further that even in the report filed by the authorities pursuant to the order passed by this Court on 11.03.2022 there is a categoric finding to the effect that the land has been assigned to the original assignee for cultivation purpose alone under the Kerala Land Assignment Rules, 1964 and in the light of the dictum laid down by this Court in Raphy John's case cited supra, I am of the view that the matter requires reconsideration at the hands of the appellate authority, to examine the contention of the petitioners that the construction of the concrete W.P.(C) No.30778 of 2021 2026:KER:6849 cemetery is in violation of the patta conditions. For the purpose of examining the said aspect alone, the writ petition is disposed of issuing the following order:
Ext.P23 appellate order issued by the 1st respondent is set aside with a consequential direction to the 1st respondent to examine the issue as to whether a concrete cemetery could be established in a patta land and whether such establishment is in violation of the patta conditions and as to whether any permission could be granted for construction of a concrete cemetery in such patta land and pass appropriate orders thereon after affording an opportunity of being heard to the petitioners and the 7 th respondent. A decision in this regard shall be taken within an outer limit of three months from the date of receipt of a copy of the judgment.
