                                             (BY SHRI BHUWAN DESHMUKH, G.A.)

T h is revision coming on for orders this day, the court passed the
                                    following:
                                                                           ORDER

It appears that the Registry has wrongly requisitioned the record of the Court below despite there being no such order and in the order which was passed on 24/11/2021, it was directed to the State to produce the case diary and not the record from the Trial Court.

In view of the same, the Registry is directed to remit the record to the lower Court at the earliest.

This revision petition has filed by the petitioner under Section 397 and Signature Not Verified SAN 401 of Cr.P.C. against the order dated 01/11/2021 passed by the Second Digitally signed by KHEMRAJ JOSHI Date: 2022.05.13 10:28:02 IST Additional Sessions Judge, Rajgarh (Biaora), District Rajgarh in ST 2 No.303/2021 for supurdgi of his vehicle which has been seized under the provisions of Essential Commodities Act, 1955.

Since an alternative efficacious remedy under Section 6-B(c) of the Essential Commodities Act, 1955 is available to the petitioner, this revision petition is dismissed as premature with liberty to the petitioner to avail the remedy available to him under the law. It is also directed that if the petitioner files an appropriate application before the concerned authority within 2 weeks time from today, the same shall be decided by the authority on its merits, without raising any objection regarding its limitation.

C.c. as per rules.
