03/27.04.2012: The petitioner has prayed for a direction on the respondents to pay the retiral dues, such as pension, D.C.R. Gratuity, Group Saving Scheme, arrears of leave salary and other amount payable to the petitioner along with interest.
It has been stated that the petitioner retired from the services of Jharkhand State Electricity Board from the post of Chief Engineer, on attaining the age of superannuation on 31st May, 2007, but till date the retiral dues, which are payable to the petitioner, have not been paid in spite of repeated requests and representations.
Learned counsel appearing on behalf of the Respondent Board submitted that if the petitioner's claim is still due, the same shall be considered and appropriate order shall be passed and if the amount(s) is/are found payable, the same shall be paid to the petitioner without further delay.
Considering the said submissions, this writ petition is disposed of, directing the respondents to consider the petitioner's claim of retiral benefits and pass appropriate order, in accordance with law, within six weeks from the date of receipt/production of a copy of this order.
If the petitioner is found entitled to get one or the other dues, the admitted amount(s) along with statutory interest shall be paid to the petitioner within six weeks thereafter.
If the amount(s) found payable to the petitioner is/are not paid within the said period, the same shall carry interest @ 10% per annum, in addition to the statutory interest, from the date the amount(s) was/were found payable till final payment.
