HON'BLE JUSTICE DR. T. AMARNATH GOUD Order 12.03.2026 When the case is called, Mr. Raju Datta, learned P.P is present on behalf of the petitioner-State. Mr. S. Sarkar, learned Senior counsel assisted by Mr. D. Gope, learned counsel appears on behalf of the respondent.
After perusal of the record, this Court finds that Mr. S. Sarkar, learned senior counsel also represented before the Court of the Sessions Judge on 27.02.2026 and thereby, obtained an order in favour of the accused person.
Mr. Raju Datta, learned P.P draws the attention of this Court to the order dated 27.02.2026 in B.A. No. 29 of 2026, wherein it has been mentioned that an application was filed seeking urgent hearing of the case. He, therefore expresses his view that as to how and under which provisions of law the same has been followed.
In view of the same, this Court intends to look into the application that made the learned Judge to prepone the case and hear it on Page 2 of 2 27.02.2026 when the actual date of listing the case was supposed to be on 2nd March 2026.
Accordingly, call for the LCRs from the Court of District & Sessions Judge and learned CJM Court.
Upon request made by Mr. S. Sarkar, learned senior counsel, to get ready with the matter, list this on 16.03.2026.
