2.   04.05.2020           Heard Mr.Jitendra Samantaray learned counsel for the
                  petitioner and Mr. Mr.Abhinandan Pradhan, learned Additional
                  Standing Counsel for the State.
                          This is an application under Section 439, Cr.P.C. for grant
                  of bail to the petitioner in connection with STF Bhubaneswar P.S.
                  Case No.07 of 2019 corresponding to G.R. Case No.486 of 2019
                  pending in the court of the learned S.D.J.M.,      Khurda for the
                  alleged     commission       of    offences     under      Sections
                  379/411/467/468/471/420/120-B/34 of the I.P.C. read with
                  Sections 25 and 27 of the Arms Act and Sections 3, 4, and 5 of
                  E.S. Act and Odisha Mineral Prevention of Theft, Smuggling and
                  other (Unlawful Activities Act) 1988.
                          Learned counsel for the petitioner submits that the co-
                  accused has already been released on bail by this Court in BLAPL
                  No.8699 of 2019.
                          Considering the submissions made by the learned counsel
                  for the parties and the materials available on record, I am inclined
                  to allow this bail application and direct that the petitioner be
                  released on bail in the aforesaid case on such terms and
                  conditions as would be deemed fit and proper by the learned trial
                  court with further conditions that he shall not commit similar
                  offence or any other offence and shall not directly or indirectly
                  terrorize or threaten or try to influence the prosecution witnesses
                  and shall not indulge in any sort of criminal activities while on
                  bail.
                          The BLAPL is accordingly disposed of.
