ORAL ORDER
5 03-01-2019The learned counsel for the respective parties are in agreement that the present batch of writ petitions can be disposed of with a direction to the respondent authorities not to make any recovery of the excess amount paid to the petitioners on account of the time bound promotion granted to them having been declared illegal, in light of the judgment rendered by the Hon'ble Apex Court in a case reported in (2009) 3 SCC 475 (Syed Abdul Qadir & ors. vs. State of Bihar & ors).
Having regard to the submissions made by the learned counsel appearing for the respective parties, the writ petitions are partly allowed and the respondents are directed not to recover the excess amount paid to the petitioners on account of the time bound promotion having been declared illegal in view of the law laid down by the Hon'ble Apex Court in the case of Syed Abdul Qadir (supra).
