Information soughtand background of the case:
The Appellant filed an RTI application dated 29.09.2023 seeking information on the following points:
"कृपया मुझे पूणगतः जननित में प्रधानमन्त्री फसल बीमा योजना (PMFBY) की खरीफ वर्ग 2021 की मध्यप्रिे श के नजला िरिा से संबंनधत ननम्ननलखखत जानकारी मेरे ईमेल पर प्रिान करने का कष्ट करें ।
1) उक्त वर्ग की नजला िरिा के नजला सिकारी केंद्रीय बैंक मयाग नित िोशं गाबाि की िल्कावार (बीनमत नकसान, बीनमत रानश, बीनमत क्षेत्र, कुल प्रीनमयम, नकसान प्रीनमयम, केंद्र एवम राज्य शासन िारा जारी प्रीनमयम, िावा रानश एवम लाभाखित नकसानों की संख्यात्मक) जानकारी
2) उक्त वर्ग की नजला िरिा के नजला सिकारी केंद्रीय बैंक मयाग नित िोशं गाबाि की िल्कावार (बीनमत रानश, थ्रे शोल्ड उपज, वास्तनवक उपज, उपज में कमी, िावा प्रनतशत एवम अंनतम िावा रानश की जानकारी) जानकारी
3) उक्त वर्ग में नजला िरिा मे नुकसान मूल्ां कन की प्रनिया की जानकारी नजससे की (बीनमत रानश/बीनमत क्षेत्र के नवरुद्ध) बीमा क्षनतपूनतग रानश का ननधाग रण नकया गया।
4) उक्त वर्ग की बीमा क्षनतपूनतग रानश नजला िरिा के नजन नकसानों के खाते में आज निनां क तक जमा निीं की गई उनकी (बैंकवार, िल्कावार) सूची। उक्त नकसानों को बीमा क्षनतपूनतग रानश निीं प्रिाय नकए जाने का कारण
5) उक्त वर्ग की नजला िरिा के कुल बीनमत (ऋणी एवम गैर ऋणी) नकसानों की संख्या, कुल बीनमत क्षेत्रफल, वि रानश जो प्रीनमयम अनुिान CIC/AGICI/A/2024/604423 Page 2 of 8 (केन्द्रां श एवम राज्यां श) के रूप में बीमा कंपनी को प्राप्त हुई एवम जो कुल प्रीनमयम रानश नकसानों से प्राप्त हुई उसकी सं ख्यात्मक जानकारी ।
6) PMFBY के पररचालन निशा ननिे श (संशोनधत) के िमां क 29.2.5 के अनुसार अपलोड की जाने वाली उक्त वर्ग की नजला िरिा के लाभाथी ऋणी नकसानों की सूची (बैंकवार, नकसान को प्राप्त क्षनतपूनतग रानश एवम नकसान का िल्का सनित)
7) PMFBY के पररचालन निशा ननिे श (संशोनधत) के िमां क 29.2.5 के अनुसार अपलोड की जाने वाली उक्त वर्ग की नजला िरिा के लाभाथी गैर ऋणी नकसानों की सूची (बैंकवार, नकसान को प्राप्त क्षनतपूनतग रानश एवम नकसान िल्का सनित)
8) उक्त वर्ग की बीमा क्षनतपूनतग रानश PMFBY के प्रावधानों के अनुसार नजस ननधाग ररत समयावनध में नकसानों को नमल जानी थी उसकी जानकारी, नजस कारण से ननधाग ररत समयावनध में क्षनतपूनतग रानश निीं िी जा सकी उसकी जानकारी ।"
The CPIO replied vide letter dated 26.10.2023 and the same is reproduced as under:-
"क्रम ांक 1 - मााँ गी गई जानकारी सिपत्र 1 पर संलग्न िैं (मेल के िारा भेजी गयी)।
क्रम ांक 2 - मााँ गी गई जानकारी सिपत्र 2 पर संलग्न िैं (मेल के िारा भेजी गयी)। थ्रेशोल्ड उपज एवं वास्तनवक उपज के आकडे का स्वानमत्व राज्य सरकार का िै , अतः यि जानकारी संबंनधत नवभाग से प्राप्त करें ।CIC/AGICI/A/2024/604423 Page 3 of 8
क्रम ांक 3 - राज्य शासन के ननिे शानुसार नसंथेनिक यील्ड के आधार पर क्षनतपूनतग िे य रानश का भुगतान पात्र नकसानों को नकया गया। योजना के अनुसार यनि नकसी अनधसूनचत क्षेत्र की अनधसूनचत फसल िे तु िानी प्रनतशत 70 प्रनतशत पाई जाती िै और बीनमत रानश 50000 िै तो क्षनतपूनतग रानश 35000 िोगी (उिािरण के तौर पर)।
क्रम ांक 4 - खरीफ 2021 मौसम में राज्य सरकार िारा निए गए उपज के आं कडों के आधार पर उन सभी पात्र नकसानों को बीमा क्षनतपूनतग रानश प्रिान की जा चुकी िै नजनकी अनधसूनचत क्षेत्र की अनधसूनचत फसल िेतु उपज में कमी पाई गई थी।

Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 03.11.2023. The FAA vide order dated 01.12.2023 stated as under:-
"1. नबंिु संख्या 2(i) का संबंध िै , वास्तनवक उपज एवं थ्रे सिोल्ड उपज के आं कडों का स्वानमत्य राज्य सरकार का िै , अतः यि जानकारी संबंनधत नवभाग से प्राप्त करें ।
2. नबंिु संख्या 2 (ii) के अनुसार, मां गी गई जानकारी आपको पिले िी प्रिान की जा चु की िै नक राज्य सरकार के ननिे शों के अनुसार नसंथेनिक उपज के आधार पर पात्र नकसानों को िावा रानश का भुगतान नकया गया था। PMFBY से संबंनधत नकसी भी प्रावधान की नवशे र् जानकारी प्राप्त बनने के नलए आप िमारी वेबसाइि www.aicofindia.com िे खें।
3. नबंिु संख्या 2 (iii) और 2 (iv) के अनुसार, मां गी गई जानकारी आपको ईमेल निनां क 01/12/2023 के माध्यम से िी गई िै ।
4. नबंिु संख्या 2 (v) के अनुसार, मां गी गई जानकारी आपको 26.10.2023 (पूवोक्त) के मेल के माध्यम से पिले िी प्रिान की जा चुकी िै ।
उपयुगक्त के अनतररक्त, सूचना का अनधकार अनधननयम, 2005 के अनुसार ररकाडग में उपलब्ध अन्य संगत सूधना आपको ईमेल निनां क 01/12/2023 के माध्यम से िी गई िै ।"
Aggrieved and dissatisfied, the Appellant approached the Commission with the instant Second Appeal.
CIC/AGICI/A/2024/604423 Page 5 of 8Facts emerging in Course of Hearing:
The appellant was present through video conference.
The respondent Mr. Deepak Patil, Regional Manager, was present through video conference.
The appellant inter alia submitted that he has sought list of the farmers on point nos. 4, 6 & 7, but incomplete information was provided by the respondent. He further submitted that as per Pradhan Mantri Fasal Bima Yojana (PMFBY), guidelines, list of the farmers along with their names has to be disclosed on the website for public viewing, but only the data without the names of farmers were provided by the respondent.
A written submission dated 26.03.2026 of the respondent is stated as under:-
"7.1. Point No. 2(i) & AY/TY Data (Original RTI Point No. 2)- The ownership and primary source of Threshold Yield (TY) and Actual Yield (AY) data lies with the State Government. Nevertheless, the shortfall and claim percentage data available with AICIL was provided to the Appellant with the reply to the original RTI Application through post and mail, the specific scanned file named. No further data is held by this Public Authority.
7.2. Point No. 2(ii) & Original RTI Point No. 3- The applicant had not clearly specified the exact mode of information sought regarding the Loss Assessment Process. However, the process was already explained in detail in the CPIO's reply dated 26.10.2023, which stated: "Compensation has been paid on the basis of Synthetic Yield as per the instructions of the State Government. As per the scheme, if the loss percentage is 70% and the Sum Insured is 50,000, the claim payable would be 35,000 (for example)." Furthermore, the detailed CIC/AGICI/A/2024/604423 Page 6 of 8 procedure of the Loss Assessment Process is clearly outlined in the PMFBY Operational Guidelines, which are available in the public domain on the relevant official websites.
7.3. Point Nos. 2(iii) & 2(iv) & Original RTI Point No. 6 & 7 Bank- wise Lists of Beneficiaries were provided to the Appellant in tabular format (CPIO reply dated 26.10.2023) and further Excel file named as "a copy of harda farmer lonee non loanee.xlsb" was sent in the First Appeal reply dated 01.12.2023. The excel file contains the Farmer Name, bank-wise, loanee / non-loanee, insured area etc. 7.4. Point No. 2(v) & Original RTI Point No. 8- The process was already explained in detail in the CPIO's reply dated 26.10.2023. Further, the timeline prescribed and procedure laid under the PMFBY Operational Guidelines and in accordance with notification of concerned season/guidelines of Central & State Government/guidelines for Portal re-opening issued from time to time followed to the extent possible which are available in the public domain on the relevant official websites."
The respondent while defending their case inter alia submitted that reply to the RTI application has been provided to the appellant vide letter dated 26.10.2023. The respondent further submitted that they have revised their reply and provided the data to the appellant vide their recent letter dated 26.03.2026. Further, the list of the farmers was also provided to the appellant on his email ID. The appellant submitted that he has not received the name of the farmers, he only got the data's, but did not get the list of farmers with details. The respondent during hearing submitted that he will provide list of the farmers along with their names, in their revised reply to the appellant.

In the light of the above facts, the respondent is directed to provide revised reply to the appellant, as submitted during hearing, within three weeks after receipt of this order. With this direction, the appeal is disposed.
