Section 233 in Bihar Board's Miscellaneous Rules, 1958

233. Prompt preparation of pension papers.

- (i) A statement on plain paper and in the handwriting of the applicant should be furnished, supported by the evidence of his contemporary employees, if available, in respect of such periods of service as are not susceptible of verification from local records. These affidavits should be made before a gazetted officer and attested by him.
(ii)The affidavit of the applicant and evidence of contemporary employees should state in full detail (a) whether the applicant was in permanent employ, and (b) whether there were any breaks in the service or any leave granted.
(iii)Age. - When the precise date of birth is not known, the 1st of July of the year of birth should be taken to be the date of birth.
(iv)Age as given in the service book, if subsequently amended, should be supported by an order of competent authority, approving the alteration.
(v)Alteration in service books and other pension papers should be made in red ink and attested.
(vi)Average emoluments. - A statement of the calculation should invariably be furnished with reference to Rules 151, 153, 154 and 156 of the Bihar Pension Rules.
(vii)Character and conduct. - Against item no. 1 on the second page of the application for pension merely 'good', 'bad', 'fair', or 'indifferent' should be noted without any remarks, which should be made only when absolutely necessary for a right understanding of the case.
(viii)The specific opinion of the head of the office should invariably be stated in each case against item no. 6 on the second page of the application for pension.
(ix)Cancelled.
(x)Any delay in the submission of the pension case for report of the audit office exceeding three months should be explained.
(xi)An officer, whose service has been for some time inferior and for some time superior, may either count-
(a)the whole as inferior towards pension or gratuity on the inferior scale, or
(b)the superior portion towards pension or gratuity on the superior scale, and the inferior portion towards gratuity on the inferior scale.
(xii)Service books and service rolls. - These records should be complete in every respect:
(a)the date, month and year of the various appointments, promotions and cessations should be clearly shown;
(b)if an officer without a substantive appointment officiated or was appointed substantive pro tempore period should or should not count towards pension under Rule 64 of the Bihar Pension Rules;
(c)similarly, in cases of officers holding temporary appointments' it should be clearly stated whether the requirements of Rule 63 of the Bihar Pension Rules have been fulfilled.
(xiii)Identification marks. - A few conspicuous marks should be specified.
(xiv)Medical certificate. - (a) If granted after the applicant has ceased to perform duty, it should be stated whether it has been accepted under Note below Rule 194(iv) of the Bihar Pension Rules.
(b)Medical certificates should be granted by commissioned medical officers and Civil Surgeons and not by an assistant surgeon or sub-assistant surgeon except when in medical charge of a district.The medical certificate should be in the form laid down in Rule 128(a) of the Bihar Pension Rules.
(c)In the case of an officer invalided as unfit for employment only in the department to which he belongs, it should be stated whether every effort was made to find for such an officer other employment suited to his particular capacity.
(d)In the case of an inferior servant who is invalided before he has attained 60 years of age, a medical certificate should be furnished as required by Rules 123 and 124 of the Bihar Pension Rules.
(xv)The date of retirement as shown in the service book, first page of the application for pension and the last pay certificate should correspond.
(xvi)Verification of service. - A statement of services should be prepared in Pension Form No. 4 of the Bihar Pension Rules, in chronological order showing the periods of interruptions, if any. In the column "how verified" of this statement periods of services verified under Rule 197(iv) of the Bihar Pension Rules from local records (such as pay bills, acquittance rolls) and by the audit offices should be clearly and separately shown in chronological order. The original verification report of the audit offices should be attached to the pension case.
(xvii)If during the last three years of service, an officer was appointed substantive pro tempore in another appointment, the nature of the original vacancy in the claim of arrangements of which he was appointed as such should invariably be stated.
(xviii)A memorandum of all periods of leave (except casual leave) taken by the officer should be appended to the pension case.
(xix)If an officer's service has been partly rendered in non-gazetted and partly in gazetted appointments, the non-gazetted portion should be verified as laid down in Rule 197 of the Bihar Pension Rules. The gazetted portion need not be verified as it is verified from the "History of Services of gazetted and other officers" compiled in the office of the Accountant-General, Bihar.
