The prayer in this Transfer Petition case is to transfer O.S.No.502 of 2009 pending before the Munsiff's Court, North Parur to the Family Court, Ernakulam, where O.P.No.968 of 2010 is pending. As held in Santha vs. Sree Kumar (1999(3) KLT 261), a case pending before the civil court cannot be transferred to the Family Court. Therefore, the Transfer Petition is not maintainable. Accordingly, the Transfer Petition is dismissed.
