FACTS
Heard today dated 17.5.2013. Appellant present alongwith her husband Shri R. K. Prusty. NTPC is represented by Shri P. K. Yadav, AGM (CPIO) and Shri M. K. Goyal, AGM. The Ministry of Power is represented by Shri D. Guha, Under Secretary. I have heard the parties and perused the relevant records.
2. The appellant had filed an RTI application dated 7.2.2012, which is extracted below:-
"(i) An application was sent to the Honouable Union Cabinet Minister of Power on 19th October 2011 in the address: 2, Krishna Menon Marg, New Delhi Pin-110003 in registered post with AD regarding "Restoration of Dignity of my husband in NTPC Ltd.
(National Thermal Power Corporation)". Three months and 19 days have already passed. Till date, I am in dark regarding the line of action taken by the authority with respect to my appeal. Please refer your letter No. 10/01/2012-RTI dated 25th January 2012 vide Diary No. 43/RTI/2012 towards my earlier application dated 9.1.2012, which was returned back to me because the mode of payment of application was in the form of court fee of Rs. 10/- instead of DD./BC/IPO.
2) If the result of enquiry is in faovur of my husband, when the result will be informed to me and who are responsible behind my severe sufferings.
3) If the result is not in faovur of my husband, then what is wrong with him? What is the measuring unit (KG, Km, Kl etc) by which the people in my appeal (application) are measure and declared perfect? Whether the same measuring unit is used or not to measure my husband?
4) What is the proof that transparency is maintained in the enquiry?

3. The CPIO had responded to it vide letter dated 20.1.2012, enclosing therewith the letter of Addl. GM (HR) which is reproduced below:-
"Please refer to your letter dated 17.10.2011 addressed to Hon'ble Minister of Power and received at our end through Ministry of Power regarding your husband, Shri Rajendra Prusty's (Sr. Supdt. TSTPP, 005518) non-promotion / career progression in NTPC.
In this regard, we may inform that, promotion, in ?NTPC is considered by a Regional Promotion Committee / Corporate Promotion Committee depending upon the Grade of the executives. Both the Committees consider the promotion of eligible executives to the next higher grade based on seniority, performance Appraisal Reprot, vacancy position, efficiency, suitability etc. of the concerned executive.
Your husband' promotion to the next higher grade was considered by the RPC / CPC on the above parameters and his suitability for promotion was decided accordingly."
4. Aggrieved with the above, the appellant has filed the first appeal.
5. During the hearing, it transpires that the appellant's husband Shri R. K. Prusty is E-VI level Executive in NTPC. It is the grievance of the appellant that her husband has not been given promotions due to him, with the result that his batchmates and juniors are now occupying position higher than him. The appellant had also sent a letter dated 17.10.2011 to the Minister of Power with the title "Restoration of Dignity of my husband and making him equivalent to his batchmate (14th Batch EET in NTPC)".
5. During the hearing, the appellant has argued that her husband is a well qualified executive and the NTPC Management has not been fair to him in his career progression. He is simply stuck-up in E-VI level, with no light at the end of the tunnel. In the RTI application extracted above, she has essentially sought to know the action taken by the competent authority on her representation made to the Minister of Power.
6. Shri Yadav submits that the promotion in NTPC is considered by a Regional Promotional Committee / Corporate Promotion Committee, depending upon the grade of the Executives. These Committees consider the promotion of eligible executives to the next higher grade on the basis of seniority, performance appraisal report, vacancy position, and suitability of the concerned executives.
7. Suffice to say that promotion to the appellant's husband can be given only by the NTPC Management. This does not fall in the domain of the Central Information Commission. The appellant has chosen a wrong forum to articulate her grievance. In any case, the requisite information has already been supplied to the appellant. I am, therefore, constrained to dismiss the appeal.
