2. The show cause of the Superintendent of Police, East Champaran is not received.
3. Heard the learned counsel for the petitioner and the learned APP for the State.
4. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 02.04.2024 passed in Cr. Misc. No. 19116 of 2024.
5. The petitioner seeks regular bail in a case registered for the offence under Sections 420, 489A, 489B, 489C & 34 of the Indian Penal Code.
6. The following order was passed on 02.04.2024 in Cr. Misc. No. 19116 of 2024:-
Heard the learned counsel for the Patna High Court CR. MISC. No.77178 of 2024(3) dt.24-01-2025 2/2 petitioner, Mr. Anand Ojha; learned counsel for the Union of India and learned APP for the State.
2. The petitioner seeks regular bail in a case registered for the offence under Sections 420, 489(A), 489(B), 489©, 34 of the Indian Penal Code.
3. As per the prosecution case, counterfeit notes of worth Rs. 26,000/- and mobile phones have been recovered from the possession of the petitioner.
4. Learned counsel for the petitioner submits that petitioner is quite innocent and has not committed any offence and the petitioner is in custody since 11.06.2023.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the serious nature of offense committed by the petitioner, I am not inclined to grant bail to the petitioner.
7. Accordingly, this application for regular bail is dismissed.
8. The court below is directed to expedite the trial of the petitioner
7. It has been submitted by the learned counsel for the petitioner that five witnesses have already been examined. Since the trial is proceeding, no ground for review is made out.
8. Accordingly, this application for regular bail is hereby rejected.
