Section 10 in The Gujarat Industrial Relations Act, 1946
10. Industrial Court.
(1)The [State] [This word was substituted for the word 'Provincial' by the Aadaptation of Laws order, 1950] Government shall constitute a Court of Industrial Arbitration.(2)The Industrial Court shall consist of three or more members, one of whom shall be its President.(3)Every member of the Industrial Court shall be a person [who is not connected with the Industrial dispute referred to such court or with any industry directly affected by such dispute:Provided that no person shall be deemed to be connected with the industrial dispute or with the industry by reason only of the fact that he is share-holder of an incorporated company which is connected with, or likely to be affected by such industrial dispute; but in such a case, he shall disclose to the State Government the nature and extent of the shares held by him in such company] [This portion was substituted and shall be deemed always to have been substituted for the words 'who is connected with any industry' by Bombay 35 of 1956, section 2.].(4)Every member of the Industrial Court shall be a person who is or has been a judge of a High Court or is eligible for being appointed a judge of such Court [or has Presided over a Labour Court for not less than ten years] [These Words were inserted by Gujarat 8 of 1962, section 3.]:Provided that one member may be a person not so eligible if in the opinion of the [State] [This word was substituted for the word 'Provincial' by the Aadaptation of Laws order, 1950] Government he possesses expert knowledge of industrial matters:[Provided further that a member, who before his appointment as such member has presided over a Labour Court for not less than ten years shall notwithstanding anything contained in section 92, be eligible for appointment on a Bench of the Industrial Court consisting only of one member and section 92 shall have effect accordingly] [This proviso was inserted by Gujarat 8 of 1962, section 3.],
