ORAL ORDER
(As per Hon'ble Dr. Lata Baswaraj Patne, Judicial Member) Heard Mrs. Anita Swain, learned counsel for the applicants and Mrs. M Swarna, learned counsel for the respondents.
2. By this Original Application, the applicants are seeking the following relief(s):-
"to declare the action of 2nd respondent rejecting vide O.M No A 12020/8/2018-1 dated 23-10-2020 to grant a notional increment on completion of one year satisfactory and unblemished service, since applicants are superannuated on 30th June of that year and increment due date is on 1 July and further inaction of respondents to extend the benefits when the matter is no more res-intigra as the law laid down by the Hon'ble Supreme Court in Director (Admn. and HR) KPTCL & Ors. v. C.P. Mundinamani & Ors. Civil Appeal No. 2471/2023 and Union of India Vs. M. Siddaraj in SLP No. 4722/2021 is highly illegal and arbitrary and discriminatory and violation of Article 14, 16 and 21 of Constitution apart from violation of principle of natural justice hence quash the O.M No A 12020/8/2018-1 dated 23-10-2020 of the 2nd respondent and consequently direct the 2nd respondent to extend the benefit of one notional increment by adding the same to their basic pension and re-fix their pension by upgrading it and to pay all consequential pensionary benefits accordingly such as arrears of enhanced Pension and DA etc. in the interest of justice and pass such further order or orders as this Hon'ble Tribunal may deem fit and proper in the interest of justice.".

When the matter has been taken up for consideration, the learned counsel for the applicants submits that the issue involved in the matter is no more res-integra, as the Hon'ble Supreme Court has already settled the issue Page 13 of 15 OA/620/2023 as well as this bench followed with the Order of the Hon'ble Supreme Court, the Hon'ble Delhi High Court and the Co-ordinate Benches.
4. The learned counsel for the applicants further submits that, if a similar order has been passed, the purpose of filing this OA will be fulfilled. In view of the same the respondents are directed to consider the applicant's representation in the light of Paras 1 and 2 of the Order of Bangalore Bench of Central Administrative Tribunal, in MA/170/00178/2023 and OA/170/00509/2020 dated 18.07.2023 which is reproduced herein below:
"2. Hon'ble Apex Court has disposed of the said matter in M.Siddaraj supra, vide order dated 19.05.2023 observing that the issue raised in the said appeal is squarely covered by the judgment rendered in C.A.No.2471/2023 decided on 11.04.2023 in the case of The Director (Admn. and HR) KPTCL & Ors. vs. C.P.Mundinamani & Ors. - 2023 Online SCC 401. The issue being the same, the said appeals are disposed of in terms of the Judgment in C.P.Munidinamani and others, supra.
3. In C.P.Munidinamani and others supra, the Hon'ble Apex court disposed of the Civil Appeal holding that the appellants therein are entitled for grant of one increment which the original Writ petitioners earned on the last day of their service for rendering their services preceding one year from the date of retirement with good behavior and efficiency, completely agreeing with the view taken by the Hon'ble Madras High Court in the case of P.Ayyamperumal vs. The Registrar and others (W.P.No.15732/2017 decided on 15.09.2017)."
5. In view of the above, it is clear that the issue involved herein is squarely covered by the Judgement passed by the Hon'ble Apex Court in C.P.Munidinamani and Others (supra). Therefore, the respondents are directed to extend the benefit of the said notional increment to the applicants. Page 14 of 15
