UPON hearing the counsel the Court made the following
O R D E R
Learned counsel for the respondent stated that the whole dispute in this case was whether the State of Gujarat could set off the amount claimed in one contract against the amount payable in another contract by way of equitable set off.
It is further stated that with regard to the amount which was sought to be withheld by the State of Gujarat has been released many years ago and therefore the matter has become academic.
Learned counsel for the State prays for one week’s time to seek instructions.
