ORDER
1. The news item highlighted the chemical waste damaging the environment adversely affecting the human health in the district of Chhattarpur the complaint contained the fact that the wastewater and toxic chemical Jaden water released from Jagpin Breweries Limited (Cox India Distillery) in the Chhatarpur, Naugaon area is now causing a serious public health and environmental issue. The water source within a radius of about 1 km from the factory has been completely polluted, and halfa dozen villages within a radius of 4 to 5 km are suffering from stench and health problems. Local organizations raise their voice in a public hearing to protest this and submitted a memorandum to SDM Shri. GS Patel. The rotten grains and waste left behind by the company after production are being neglected and 1 O.A. No.139/2025(CZ) News Item Titled "Sharab Factory Se Niklne Wale Chemical Waste Se 1 Km. Tak Faily Badbu Swasthya Aur Paryavaran Ko Nuksan" appearing in Patrika Dated 20th September, 2025, Vs. State of M.P. & Ors. chemical-laced waste is being dried in the open. The resulting stench has made life difficult not only for residents of Naugaon, but also for residents of villages like Chandrapur, Shikarpura, Chandora, Doriya, Khamma, Rawatpura, and Dhavrra. Residents say the stench becomes even more intense in the morning and evening, leading to headaches, eye irritation, difficulty breathing, and vomiting.
2. It is further submitted that the above facts are adversely affecting the crops and water is being contaminating affecting risk of kidney diseases and other serious health problems.
3. The matter highlighted in the news reporting was registered as a original application vide order dated 13.10.2025 and a committee was constituted with direction to submit the factual and action taken report. The members of the committee including the representative of the Collector and the State Pollution Control Board visited the site and submitted the report as follows :-
"Field Observation of the Joint Committee This report is submitted by the Joint Committee following a field visit conducted on 17th November, 2025 and 20th November, 2025 to examine the issues raised by the applicant.
Observations during the field inspection:-
The Committee visited sites as part of the inspection:-

O.A. No.139/2025(CZ) News Item Titled "Sharab Factory Se Niklne Wale Chemical Waste Se 1
Km. Tak Faily Badbu Swasthya Aur Paryavaran Ko Nuksan" appearing in Patrika Dated 20th September, 2025, Vs. State of M.P. & Ors. The observation of the site :-
Upon inspection, the Committee observed that the site had been completely converted into open space as all the distillery wet grain soluble was removed by the industry management. No foul gases was observed. No fugitive emissions, surface runoff, groundwater contamination, or soil pollution were observed during the visit. There was no DWGS spreading found inside and outside the industry premises.
It is pertinent to mention that after receiving complaints from local residents of tehsil naugaon and public representatives, the District Administration conducted an inspection of the site and observed that rotten wet waste (DWGS) was being stored outside the premises of the unit.
During the morning and evening hours, due to dominant wind conditions, foul gases were spreading into the surrounding environment, thereby causing environmental pollution and problem to residents.
Vide letter No. 620 dated 19.09.2025, the Additional District Magistrate (ADM), Chhatarpur requested the Madhya Pradesh Pollution Control Board, Sagar to inspect the industry and submit a factual and technical report.
Accordingly, an inspection on dated 25.09.2025 was carried out by the Regional Officer, MPPCB, Sagar, and the inspection report was submitted to the MP Pollution Control Board Bhopal and the District Magistrate, Chhatarpur.
Based on the findings of the inspection, a Closure Notice vide letter no. 2297 dated 08.10.2025 was issued to the unit under Section 33(A) of the Water (Prevention and Control of Pollution) Act, 1974 and Section 31(A) of the Air (Prevention and Control of Pollution) Act, 1981, directing the unit to rectify the violations and the shortcomings observed during the inspection. Along-with letter to reject consent order was issued by MPPCB, Bhopal vide letter no. 2298 dated 08.10.2025.
4O.A. No.139/2025(CZ) News Item Titled "Sharab Factory Se Niklne Wale Chemical Waste Se 1 Km. Tak Faily Badbu Swasthya Aur Paryavaran Ko Nuksan" appearing in Patrika Dated 20th September, 2025, Vs. State of M.P. & Ors. In reply to that industry management has submitted the reply to MPPCB, Bhopal vide letter no. 355 dated 15.10.2025 stating that management 02 Nos. of bundle driers and maintained and placed in operation as per the directions of regional officer, MPPCB Sagar.
During the follow-up inspection, by regional officer, MPPCB and senior officer Mr. D.K. Jain (Executive Engineer) the said dryers were found installed and in operation and now DWGS Distillery wet grain soluble was found stored within or outside the premises. Thereafter after submission of joint inspection to MPPCB Bhopal closure direction revoke order was issued by the MPPCB Bhopal vide letter no. 2452 dated 07.11.2025.
For assessment of potential air pollution and ground water contamination from the industrial activity, the air sampling and water sampling was done by the lab in-charge of regional office MPPCB Sagar.
Air monitoring and ground water sample from nearby river located at approximately 09 KM distance aerially from the industry. The analysis results of the water sample and air monitoring results are also attached.
As per MP Public health engineering department quality of drinking water was found satisfactory.
Conclusion:-
In compliance with the Hon'ble National Green Tribunal (NGT) order dated 13.10.2025 in O.A. No. 139/2025 (CZ) News item titled sharab factory se niklne wale chemical waste se 1 km tak faily badbu swasthya aur paryavaran ko nuksan appearing in Ptrika dated 18th Sept 2025V/s State of Madhya Pradesh & Ors the Joint Committee conducted an inspection on 17.11.2025 and 20.11.2025 at the following locations:
1) M/s. Jagpin breweries Ltd, Village Shikarpura, Tehsil Naugaon, District Chhatarpur, 5 O.A. No.139/2025(CZ) News Item Titled "Sharab Factory Se Niklne Wale Chemical Waste Se 1 Km. Tak Faily Badbu Swasthya Aur Paryavaran Ko Nuksan" appearing in Patrika Dated 20th September, 2025, Vs. State of M.P. & Ors.
2) (Latitude 25.039514, Longitude 79.427355) Village Sikarpura, Tehsil Naugaon, District Chhatarpur and
3) (Latitude 25.045733, Longitude 79.430155) Village Sikarpura, Tehsil Naugaon, District Chhatarpur The Joint Committee visited the aforementioned sites and inspected the site where DWGS was previously stored.
During the inspection, it was observed that the Project Proponent (PP) had obtained requisite consent from the Madhya Pradesh Pollution Control Board (MPPCB) and secured all other relevant documents."
4. Learned counsel for CPCB has submitted that the matter of compliance of the Air (Prevention and Control of Pollution) Act, 1981 and Water (Prevention and Control of Pollution) Act, 1974 is to be complied by the State PCB and State PCB have been empowered to take necessary action according to rules in-case violations are found, learned counsel for the State PCB Ms. Parul Bhadoria has submitted that the members of the committee visited the site and found that consent status from the regulatory authority have been issued and valid upto 31.10.2028 and there was no nuisance observed during the site visit in respect of Air (Prevention and Control of Pollution) Act, 1981 and Water (Prevention and Control of Pollution) Act, 1974 and the water quality was found to be satisfactory.
5. The conditions laid down in the concerned letter have been complied with.
We have also examined the recommendations of the joint committee and of the view the recommendations which are as under are required for complied with -

"Recommendations of the Joint Committee
1. It is recommended that the Project Proponent shall be operate and maintain its both the bundle driers and also install the vertical ring drier with automatic feeding mechanism.
2. The Project Proponent shall undertake repair boundary wall of industry premises.
3. The Project Proponent shall undertake plantation activities on all reclaimed sites to ensure ecological restoration.
4. Industry management shall maintain and operate the multi-effect-evaporator effectively. All the records shall be maintained in logbook including the electricity meter readings.
5. Industry management shall comply with the conditions incorporated in consent obtained from MPPCB."
6. We direct the project proponent to comply the recommendations of the committee in letter and spirit. The State PCB is directed to regularly monitor the violations and in-case any violation is found, State PCB is directed to take necessary action according to rules.
7. With these observations Original Application No. 139/2025 stands disposed of.
