Order 30/07/2020 These writ petitions have been filed by the petitioners, who are students of Bachelor of Ayurveda Medicine and Surgery ('BAMS'), which is a five years course and is governed by Indian Medicine Central Council (Minimum Standards of Education in Indian Medicine) Amendment Regulations, 1986 ('Regulations, 1986') as amended from time to time.
All the petitioners were granted admission prior to 2016 in BAMS course. The petitioners, who are in various years of their BAMS course i.e. First Year or Second Year or Third Year, apparently are not too bright, inasmuch as, all of them have failed in four attempts in passing particular papers and on account of their failure to pass the papers in four attempts, when they attempted to fill examination forms for the fifth attempt, they were not permitted to fill-up the examination form.
It is submitted that the petitioners have been prevented from filling-up the examination forms on account of the provisions of amendments made in the Regulations in 2016, whereby in the scheme of examination, maximum four chances have been provided for passing the examination within a period of maximum three years for the first professional examination, second professional examination and third professional examination.
It is submitted by learned counsel for the petitioners that action of the respondents in preventing the petitioners from appearing in the respective examinations by way of fifth attempt (Downloaded on 31/07/2020 at 08:48:00 PM) (17 of 22) is not justified, inasmuch as, the petitioners were granted admission prior to coming into force of the Amendment Regulations, 2016 and the University itself issued circular dated 17.04.2018 (Annex.-8 in SBCW No. 5679/2020), specifically indicating that the said Regulations, 2016 would apply to students, who were admitted after the year 2017. Further, there was no such restrictions at the time when the petitioners were accorded admission i.e. under the Amendment Regulations, 2012 and, therefore, the action of the respondents in preventing the petitioners from appearing in the examinations by way of fifth attempt is not justified.
It was prayed that the action of the respondents in preventing the petitioners from filling-up the examination form/appearing in the examination be set aside and as the petitioners were prevented from filling-up the examination forms within the prescribed time limit, the respondents be directed to permit the petitioners to fill examination forms without late fees.
Learned counsel for the respondent-University made submissions that though initially the stand of the University was also that the Amendment Regulations, 2016 would not be applicable to students, who were admitted prior to 2016, however, this Court in Govind Soni v. Registrar, Dr. Sarvepalli Radhakrishnan Rajasthan Ayurvedic University : SBCW No. 7789/2019, has laid down that the Amendment Regulations, 2016 shall operate even for the students, who though were admitted prior to Amendment Regulations, 2016 coming into force, but have not passed out the course as yet, therefore, the University has applied the Regulations, 2016 and in terms of the Regulations, (Downloaded on 31/07/2020 at 08:48:00 PM) (18 of 22) the petitioners are ineligible to give fifth attempt and, therefore, they have been rightly restrained by the respondent-University and, consequently, the petitions deserve to be dismissed.
I have considered the submissions made by learned counsel for the parties and have perused the material available on record.
The facts are not in dispute that all the petitioners were admitted prior to coming into force of Amendment Regulations, 2016 and that they have failed to pass in all the subjects of their respective years despite giving four attempts.
The Amendment Regulations, 2012 in the Scheme of First, Second and Third Professional Examination, inter alia, provided as under:-
"6.1 First Professional Examination:
iii) A student failed in not more than two subjects shall be held eligible to keep the terms for the second professional course, however, he/she will not be allowed to appear for second professional examination unless he/she passes in all the subjects of the first professional.
6.2 Second Professional Examination:
iii) A student failed in not more than two subjects shall be held eligible to keep the terms for the third professional course, however, he/she will not be allowed to appear for third professional examination unless he/she passes in all the subjects of the second professional examination.
6.3 Third Professional Examination:
iii) A student failed in not more than two subjects shall be held eligible to keep the terms for the final professional course, however, he/she will not be allowed to appear for final professional examination unless he/she passes in all the subjects of the third professional examination."
A look at the above provision would reveal that the Regulations, 2012 provided that if a student failed in not more (Downloaded on 31/07/2020 at 08:48:00 PM) (19 of 22) than two subjects, he shall be eligible to keep terms for the next professional course, however, he would not be permitted to appear for the next professional examination unless he passes in all the subjects of the year. There apparently has been no restriction on the attempts, in which a student is required to pass particular professional examination i.e. First, Second or Third.
By way of Amendment Regulations, 2016, apparently on account of past experience where the students could not pass a particular year examination for several years, the following provisions in the Scheme of Examination have been introduced for First, Second and Third Professional Examination:-
"6(1)(c). The failed student of first Professional shall be allowed to appear in second professional examination, but the student shall not be allowed to appear in third professional examination unless the student passes all the subjects of first professional examination and maximum four chances shall be given to pass first professional examination within a period of maximum three years.
6(2)(c). The failed student of second Professional who have passed all the subjects of first professional examination shall be allowed to appear in third professional examination, but the student shall not be allowed to appear in final professional examination unless the student passes all the subjects of second professional examination and maximum four chances shall be given to pass second professional examination within a period of maximum three years.
6(3)(c). The failed student of third Professional who have passed all the subjects of first and second professional examinations shall be allowed to appear in final professional examination and maximum four chances shall be given to pass third professional examination within a period of maximum three years."
The above amended Regulations, 2016 introduced maximum four chances for passing in any particular professional examination and that also within a period of maximum three years. (Downloaded on 31/07/2020 at 08:48:00 PM)
(20 of 22) Based on the above amended Regulations as admittedly all the petitioners had failed in their four attempts to pass their professional examinations, they were not permitted to fill-up the examination forms for their fifth attempt.
It is not in dispute that none of the petitioners despite failing in First, Second or Third Professional Examination have been allowed to appear in the Second, Third or Forth Professional Examination i.e. they have not been granted the benefit of the first part of the Amendment Regulations, 2016 and they continue to be governed by the Amendment Regulations, 2012, which provided for a bar in appearing for subsequent professional examination unless the student has passed in all the subjects of the earlier professional examination.
A close scrutiny and comparison of the Amendment Regulations, 2012 and Amendment Regulations, 2016 would reveal that the Scheme of Examination of both the Amendment Regulations are totally different and the apparent logic behind providing for the maximum four chances that also within a period of maximum three years under Amendment Regulations, 2016 is based on the fact that now a provision has been made that a student, who has failed in First Professional Examination is permitted to appear in the Second Professional Examination and so on i.e. a student failing in Second Professional Examination is permitted to appear in the Third Professional Examination and student failing in the Third Professional Examination is permitted to appear in the Final Professional Examination and, therefore, ceiling on the maximum attempts appears to have been introduced, whereas in the Amendment Regulations, 2012, unless (Downloaded on 31/07/2020 at 08:48:00 PM) (21 of 22) a student had passed in a particular Professional Examination, he was not permitted to appear in the subsequent Professional Examination coupled with the fact that there were no maximum attempts for passing in any particular professional year.
Therefore, apparently for applying the ceiling of maximum four chances within a period of maximum three years as prescribed under Amendment Regulations, 2016, it is necessary that the student, who had failed in his First, Second or Third Professional Examination has been permitted to appear in the Second, Third or Fourth Professional Examination, which is not the case qua the present petitioners, who have not been permitted to appear in the subsequent years' examinations without passing their previous years examination.
As the bar of four attempts is contained in the same clause 6(1)(c), 6(2)(c) and 6(3)(c) respectively and not independent of its previous part, unless the previous part of the clause has been availed of by the students, the subsequent part cannot be imposed/the students cannot be restricted on account of their availing maximum four chances.
So far as the judgment in the case of Govind Soni (supra) is concerned, the same by itself cannot arm the respondent- University to apply the restriction of four chances unless the students, as observed hereinbefore, have availed the benefit of previous part of the provision i.e. despite failing in their earlier year, have been permitted to appear in the later years' examination. As such, the reliance placed on the judgment in the case of Govind Soni (supra), is of no avail to the respondent- University.

(22 of 22) In view of the above discussion, the action of the respondents in preventing the petitioners from filling-up the examination forms for/not permitting to appear in exams of their respective professional years on account of their having availed four chances, cannot be sustained.
Consequently, the writ petitions filed by the petitioners are allowed. The action of the respondents in holding the petitioners as ineligible for appearing in their respective examinations, is quashed and set aside. The respondents are directed to permit the petitioners to fill-up their examination forms within a period of one week and to appear in the ensuing examinations, if they otherwise fulfill all the eligibility conditions.
In view of the fact that the students were prevented from filling-up the examination forms in time, the respondents would not charge late fees from the petitioners.
