ORAL ORDER
22 12-04-2023Heard the petitioner in person and learned counsel for the respondents.
Although at the initial stage, the petitioner had filed this application seeking directions of this Court in connection with several cases, however, subsequently the instant application was confined to Hawai Adda P.S. Case no.217 of 2020, registered on 19.12.2020, under sections 379 and 420 of the Indian Penal Code and sections 65, 66B, 66C, 66E, 67, 72 and 72A of the I.T. Act.
A supplementary counter affidavit has been filed on behalf of the respondents sworn by the Assistant Superintendent of Police, Sadar and In-charge of Deputy Superintendent of Police, Sachivalaya, District- Patna, wherein it has been stated that the Superintendent of Police, Central having perused and considered the material collected during course of investigation, directed the Investigating Officer to submit final form as 'Lack of Evidence'. Accordingly, Final Form no. 01 of 2023 dated 17.1.2023 (Annexure-A to supplementary counter affidavit) has Patna High Court CR. WJC No. 2430 of 2018(22) dt.12-04-2023 4/4 been prepared by the Investigation Officer.
In the opinion of the Court, final form having been submitted, in connection with Hawai Adda P.S. Case no.217 of 2020, nothing remains for the petitioner in the instant application.
The petitioner will be at liberty to raise his remaining grievances in the learned trial Court where the respective case(s) are pending which, if filed, will be decided by the learned trial Court in accordance with law.
This application stands disposed of.
