ORDER
Per S.K. Sinha, M[A]:-
Short facts of the case are that the CSIR-CIMFR paid honorarium on 25.03.2021 to its employees/staff including the applicants. Later on, 14 direction for recovery of that honorarium amount was passed by the respondents and being aggrieved of said direction, aforesaid OAs have been preferred. These OAs were heard in part yesterday and the hearing proceeded further today.
2. During the hearing Sr. Advocate Shri Adish C. Agrawal appearing for respondents placed on record a letter issued by CSIR headquarters addressed to Director CSIR-CIMFR, Dhanbad dated 16.12.2022, which reads as under:-
"Sub:- Payment of honorarium to employees of CSIR-CIMFR, Dhanbad Ref 1: CSIR Email dated 31.03.2021 for recovery of honorarium 2: OM No. 12/123/CSIR guidelines/TMD-SeMI-2021 dated 26.03.2021 issued by Head/TMD The orders of DG, CSIR vide email dated 31.03.2021 for recovery of honorarium is withdrawn without prejudicing the rights of CSIR-CIMFR to take appropriate action as per rule. Notices issued to individual officials should also be withdrawn.
This issues with the approval of Director General, SCIR with the concurrence of FA/CSIR."
3. Placing on record above quoted letter ld. counsel for respondents further submits that in view of this later and decision of the respondents, all these OAs have become infructuous. Counsel for applicant also urged that after this decision of respondents, prayer made in the OAs have become infructuous and appropriate order disposing of the OAs may be accordingly.
4. Considered the submissions. All these fifteen OAs, namely OA 617/2022, 675/2022, 683/2022, 685/2022, 686/2022, 688/2022, 689/2022 690/2022, 743/2022, 744/2022, 745/2022, 751/2022, 752/2022 and 753/2022 have become infructuous after the issuance of aforesaid letter, all these OAs are disposed of as infructuous. Pending MAs, in all these 15 OAs are also disposed of accordingly.
