ORAL ORDER
The petitioners have approached this Court seeking a writ of mandamus directing respondent No.4 and 5 to regularise the unauthorised occupation of lands in question under Rule 108-CC of the Karnataka Land Revenue Rules, 1966 [for short 'KLR Rules'], by considering their representation at Annexures-D and E series.
2. Learned Additional Government Advocate for respondents-State has filed an affidavit of respondent No.5- Tahasildar, Shiggaon. In paragraph No.9 of the affidavit has stated as under;
"9. I state that, the Sy.No.145 of Hulsogi village is 'Gomal land' and it cannot be regularized. After receipt of the application seeking regularization of unauthorized cultivation, the same has been placed before the Bagar Hukkum Saguvalli Regularization Committee. After verification and land classification, it has been found that, the land in question is 'Gomal' land and the land available for grazing in the said village is less than the minimum extent, prescribed under the Rule 97(1) of the KLR, -4- NC: 2026:KHC-D:1565 WP No. 109475 of 2025 HC-KAR Rules, 1966 and further that regularization is barred under Government Circular dt.05/01/2007 and the same has been placed before the committee for rejection, and it is still pending before the Respondent No.1 on 13/07/2023 and on 20/10/2023, the Respondent No.5 was pleased to pass the order rejecting the FORM No.57 filed in Shiggaon taluka and in the said Order the Hulsogi village is also mentioned at Sl. No.119 with 7 number of applications stating the reason for rejection as it is 'Gomal Land'. The document of proceedings before the respondent No.1 is produced herewith as Document No.2."
3. It is specifically stated that Sy.No.145 of Hulsogi village is classified as "Gomal Land" and therefore is not eligible for regularization. It is further stated that upon verification and classification, it was found that extent of grazing land available in the said village is less than minimum extent prescribed under Rule 97(1) of the KLR Rules, and that the regularization is also bald in terms of circular dated 05.01.2007. Consequently, the applications were placed before Bagar Hukkum Saguvali Regularization Committee for rejection.

It is further brought to the notice of this Court that order dated 20.10.2023, respondent No.5 has rejected 7 applications including the application of the present petitioners, and the land in question finds mention at Sl.No.119, assigning the reasons that the land is "Gomal Land". The said affidavit and the documents produced along with it are taken on record.
5. In view of the aforesaid rejection order dated 20.10.2023, the grievance of the petitioners that their representation have not been considered and does not survive for consideration.
6. At this stage, learned counsel for the petitioners submits that liberty may be reserved to challenge the order dated 20.10.2023, in accordance with law. The said submission is placed on record.
7. Having regard to the fact that an order has already been passed by respondent No.5, rejecting the applications filed, liberty is reserved to the petitioners to -6- NC: 2026:KHC-D:1565 WP No. 109475 of 2025 HC-KAR challenge the said order dated 20.10.2023, if so advised in accordance with law. Accordingly, the writ petition is disposed of.
