HONBLE JUSTICE MR. KALIDAS MUKHERJEE, PRESIDENT These are the 14 Revisional Applications of identical nature filed by the Revisions Petitioners against the orders dated 30/08/13, 02/09/13 and 03/09/13 passed by the Learned District Forum, Burdwan whereby the Learned District Forum rejected the petition filed by the Complainant praying for amendment of the complaint. The OP of the complaint strongly opposed the petition for amendment and contended that if the amendment was allowed it would change the nature and character of the complaint and the documents referred to did not relate to any subsequent event. Accordingly, the Learned District Forum after due consideration rejected the petition for amendment.
The Learned Counsel for the Revision Petitioner has submitted that the Learned District Forum was not justified in holding that the amendment, if allowed, would change the nature and character of the complaint. It is contended that the amendment should be allowed in the interest of justice.
None appeared on behalf of the Respondent.
We have heard the submission made by the Learned Counsel for the Revision Petitioner and perused the papers on record. It appears that the complaint cases were pending at the stage of hearing argument. Since the matter in issue reached the final stage and at that belated stage the petition for amendment having been filed by the Complainant, the Learned District Forum did not commit any material irregularity or illegality in passing the impugned order.
The Revision Petitions are dismissed. This order will govern all the Revision Petitions as stated above.
