RULE.

Mr.U. A. Trivedi, learned APP waives service of rule on behalf of the respondent State.

The convict - prisoner has filed this application through jail for availing parole leave for a period of 90 days on the ground that he is suffering from T.B. Learned APP for the respondent State has submitted that the convict - prisoner was convicted for the offence punishable under the provisions of the N.D.P.S. Act and sentenced to undergo rigorous imprisonment of ten years and fine of Rs.1 Lakh. He has submitted that the convict prisoner preferred Criminal Appeal is pending before the Division Bench of this Court and, therefore, the present application deserves to be dismissed.

I have perused the papers and report of the jail authority, I am of the view that the convict prisoner had preferred Criminal Appeal which is pending before the Division Bench of this Court, the present application is not required to be entertained and hence, the present application deserves to be dismissed.

In view of the above, this application stands dismissed. Rule is discharged.
