The present petition has been filed praying for a writ of mandamus commanding the respondent-Gautam Budh Nagar University, Gautam Budh Nagar to process the PH.D. thesis submitted by the petitioner on 18.5.2020 for pre-submission.
In pursuance to the previous order passed by this Court, Shri Rahul Agrawal, counsel for the University has obtained instructions and has handed over a copy of the same to the Court, which is taken on record.
The facts of the case as evidenced from the petition and from the instructions obtained by the counsel for the University are that the petitioner was registered as PH.D. student on 4.2.2015.
It is the case of the petitioner that her PH.D. thesis could not be processed because the Supervisor/Guide of the petitioner had withdrawn before the petitioner submitted the said thesis. However, the instructions obtained by the counsel for the University indicate that the petitioner without any information or approval of the Research Degree Committee changed her doctoral research topic and submitted two different copies of the thesis for evaluation on 10.8.2019.
The PH.D. thesis of the petitioner was sent to external Experts for evaluation; the report of the Experts is reproduced below :-
"Hence it may be concluded that
(a) The thesis work is totally junk and dirt.
(b) It is unfortunate to observe that thesis has plenty of grammatical and spelling mistakes. It seems that before submission the work has not been perused by the candidate.
(c) Undersigned are falling short of words in reporting the problems in the thesis."
The thesis of the petitioner has already been evaluated and an adverse report signifying that the petitioner can not be awarded the degree has been submitted by the Experts.
The Court under Article 226 of the Constitution of the India refrains from interfering in the evaluation of the Experts as the thesis of the petitioner has already been evaluated.
There is no cause of action for the petitioner to file the petition for a mandamus as noted above.
The petition is dismissed.
