Prayer in the petition is for quashing of FIR No.416 dated 20.07.2021 under Sections 417, 498-A, 34 IPC, 1860, registered at Police Station Zirakpur, District SAS Nagar (Mohali), Annexure P-1, in which Section 406 of IPC was added vide Rapat G.D. No.45 dated 20.08.2021, Annexure P-2.
Counsel for the petitioners submits that in pursuance to order dated 17.09.2021 passed by the Additional Sessions Judge, SAS Nagar, Mohali, the petitioner has deposited a sum of Rs.2 lakhs before the trial Court.
Upon instructions from ASI Ramesh Lal, State counsel submits that the matter is at the stage of investigation.
Faced with this situation, counsel representing the petitioner seeks and is granted permission to withdraw the petition with liberty to bring all the documents to the notice of the Investigating Agency and liberty is granted to the petitioner to file a fresh petition, in case he is so advised.
