Section 85(1) in The Orissa Grama Panchayats Election Rules, 1965
(1)[Unless the Commissioner otherwise directs] on receipt of information under Rule 84 or his own information about the existence of the vacancy, the Sub-Collector shall forthwith report the fact to the Commissioner who shall appoint, as soon as practicable, the date and place for holding a bye-election to fill up the vacancy.]
