Learned counsel for the State, on instructions from Head Constable Rajinder Kumar, Police Station Focal Point, Ludhiana, submits that in view of the averments taken in preliminary submissions in the written statement filed by way of counter affidavit of Mukhtiar Singh, Assistant Commissioner of Police, Atam Nagar, Ludhiana on behalf of respondents No. 3 to 5, as and when the Regional Passport Officer, Chandigarh-respondent No.2 shall seek the police verification of the petitioners, the same shall be reported as per latest record and at an early date.

Learned counsel for respondent No. 1 and 2 submits that as and when the petitioners will approach the Regional Passport Officer, Chandigarh, by way of an appropriate representation, the same shall be considered and police verification shall also be sought from the State at the earliest possible time. He further submits that if the police verification is received in favour of the petitioners, they shall be issued passport without any further loss of time, however, in accordance with law. Learned counsel for the respondents jointly pray that in view of the abovesaid factual aspect of the matter, let the present petition be disposed of.

Learned counsel for the petitioners fairly states that he is not averse to the proposal put by the learned counsel for the respondents and let the present petition be disposed of in terms of the statements made by learned counsel for the respondents.

Having heard the learned counsel for the parties and without commenting upon the merits of the case, the present writ petition is disposed of with liberty to the petitioners to approach the Regional Passport Officer, Chandigarh-respondent No.2 raising their grievance by moving an appropriate representation/application. As and when such an application is moved by the petitioners, respondent No.2 is directed to consider the same and seek police verification from the respondent State authorities. After receiving the police verification report, respondent No.2 shall process the matter further and take an appropriate action, in accordance with law, issuing the passport in favour of the petitioner, as per the relevant rules on the subject. However, respondent No.2 shall take appropriate action without any further loss of time, by passing an appropriate order, in accordance with law.

Disposed of accordingly.
