1. Heard counsel for the petitioner in all the cases. As these cases involve similar facts and the same legal issue, these are taken up together.RP/1612/2025 and connected Page 15 of 29
- 2. All these cases have been filed with a delay exceeding 100 days (delay of 131 days in RP/1612/2025). Condonation of delay applications have been filed seeking condonation of delay. Although the reasons stated are not found convincing, in the interest of justice we allow the delay in filing the RP and decide to take up the case on merits.
3. Challenge in these 26 cases is to the order dated 07.10.2024 of the State Commission vide which 26 First Appeals filed by the complainant farmers were allowed. The challenge before the State Commission in these 26 First Appeals were to the order dated 11.08.2023 of the District Commission, which was a common order for 64 complaints, out of which 37 complaints were allowed but the remaining 27 were not allowed. These 26 First Appeals arose out of the 27 complaints which were not allowed. The details of the 27 complaints not allowed by the District Commission are contained in para 13 of the District Commission order. Extract of the relevant portion of this para of the District Commission is reproduced below:

' 4. While allowing the 26 appeals and holding both the bank (petitioner herein) and insurance company liable jointly and severally with respect to these 26 cases, the State Commission observes as follows:

(1)We have paid you permium for 114535 members agriculturists for total sum assured of Rs. 24086.58 lacs. For this we had paid you premium for Rs. 1,92,69,264/-.
(3) We had received total 1361 claims from our members, which were lodged with your company for total Rs. 483.43 lacs. Out of the total claims submitted, you have till date made payment for only 357 claims amounting to total Rs. 117.26 lacs. The remaining 977 claims for Rs. 357.42 lacs are pending.
(4)(i) If any claim was lodged and paid in good faith, which were not payable the same could be adjusted from the pending payable claims. It is not fair to deny the liability on the basis of ascertaining mistakes.
(4)(ii) We have observed that claims of few members were received who were not entitled for the claim, but paid by mistake. To be fair enough we are prepared to bear the loss of payment already remitted to illegible members, as it is difficult to receive back the payment made from nominees of those who were not entitled for the claim. However we are prepared to bear that loss at our end but at the same time we request and insist you not to deny your enforceable liability. As in that case we would be forced to take unnecessarily unpleasant steps which both your and our organization would never prefer to take.
(5) Whilst raising the claims the aspect of crossing age of 59 years and because of that those members were not entitled to RP/1612/2025 and connected Page 17 of 29 claim was due to oversight neither verified at our end nor at your end and by mistake claims of few members were paid. Still we are prepared to bear that loss of those paid claims against pending receivable claims of entitled members. (6) Still, if you wish you may get the pending claims investigated for confirmation of age and death of members for your satisfaction and then make the payment, so that there remains no confusion in your mind and complete transparency exists.

During the hearing, the counsel for the petitioner drew our attention to the policy document at page 100 onwards, which is a group term insurance master policy document entered into between the petitioner bank herein and the insurance company (Bajaj Allianz Life Insurance Company). The scheme was meant for the members of the Jila Sahakari Kendriya Bank Shakha Khargone (petitioner herein), who have been defined as a granting association under the scheme.

Although it is claimed that under the scheme only those loanee farmers of the bank were eligible to participate who were between the age of 18 to 59, a perusal of the document on record at page 100-111 does not indicate such age condition. It could possibly be due to omission of certain annexures or schedules to the policy document which were not placed on record by the petitioner herein along with the policy, as the policy document at page 100 states that the eligible member shall be a member who is or shall become eligible to the benefit of this policy as more particularly set forth in Part-1 of the schedule hereto. Even the eligibility clause mentioned at page 107 of the said document does not contain any age-related condition.

However, even if we accept the contentions of the petitioner herein that age was an important criteria of eligibility and only those persons who were in the age group 18-59 and were eligible to participate, the eligibility RP/1612/2025 and connected Page 20 of 29 ■ condition in the said document clearly states that the insurer for the purpose of the scheme shall take the age of the member as admitted in the record of the guarantee association i.e., petitioner bank herein. The said eligibility clause is reproduced below:

In the present 26 cases it is admitted by the counsel for the petitioner that premium was indeed deducted from the accounts of these 26 farmers and remitted to the insurance company, hence prima facie the observations of the District Commission in para 13 of its order leading to rejection of their complaint is wrong, and the State Commission has rightly given similar observations about the District Commission order in para 13.
9. During the hearing our attention was also drawn towards letter dated 20.08.2008/11.09.2008 from the petitioner bank to the insurance company.
This letter refers to certain other earlier correspondence between the bank and the insurance company, but the same have not been placed on record. This being an important communication essential for adjudicating the RP/1612/2025 and connected Page 21 of 29 ' present case, we considered it necessary to reproduce the same (without detailed annexure list).

receiving your letter under reference, examined, all the cases Including the cases already Paid and have observed that claims of few members were received who were not entitled for the claim, but Paid by mistake. (5) We may mention that our bank had submitted Claims In good faith. Whilst raising the claims the aspect of crossing age of 59 years and because of that those members were hot entitled to claim was due to oversight neither verified atour end nor ar your end and by mistake claims of few members were paid. The claims received from your end were disbursed.to the Nominees/ beneficiary of the concerned, Is not with die bank. You wlll appredate that It Is very difficult for us to receive back the payment from Nominees/beneficlary of the concerned members to whom those claims were paid. Still we are prepared to bear that loss of those paid claims against pending receivable claims of«entitled members.
(6) You have alleged that we have misrepresented the,figure of No. of death during 2005-06. For this we have examined the case and have been Informed that the figure indicated at 739 nos. was gathered In the mid of the year when the policy was being framed. There was no point of njfSrepresentatlon as your such policy in no way going to benefit the bank and no body from our bank had any malafide Intention. If you still feel we may examine the date upto which the death no. of 739 had reached during the year 2005-06. So please remove all the confusions you have in our case and come forward with positive approach.
Still, If you wish you may get the' pending ' claims investigated for confirmation of age and death of members for your satisfaction and;BiiNiTihJ3 , then.makS-Hlg •payrnent, so that there remains no confusion In your.mlnd and complete transparency 'exists. ~ (7) We have now given our thoughts to the 3 options offered by you. The option no.
a) of letter no. 2008/1549 dated 21.1.2008 is fair enough, equitable, should be agreeable to all. For this, we have gathered correct Information of the deceased members and have drawn the detailed list which Is as under:-

a. Premium was indeed deducted from the accounts of these 26 complainant farmers and remitted to the insurance company, admitting that the bank had submitted such claim in good faith. This letter clearly states that while raising the claims in respect of these members crossing the age of 59 years, and because of that those members not being entitled to claim, it was due to oversight and non verification at the bank's end, and not only that, this letter admits that by mistake some of these claims have already been paid and in some of these claims (other than these 26 cases) the bank is prepared to bear that loss of those paid claims against pending receivable claims of entitled farmers.
b. This letter in addition to containing list of 327 complainant farmers whom the bank claims to be eligible, also contains a list of 52 complainant farmers whom the bank is now classifying as not eligible due to attaining the age of 59 years. Counsel for the petitioner submits that these 26 farmers are included in the second part of the list of 52 who are not found eligible now. As an example, they showed us two names, namely Mr. Babulal of RP/1612/2025, whose name appears at SI. No. 33 of the list, and Mr. Rameshwar of RP/1614/2025, whose name appears at SI. No. 43 of the list of 52 persons. However, he was not in a position to categorically state whether all the 26 names are included in list of 52 as there are some overlapping names.

We have carefully gone through the orders of the State Commission, District Commission and other relevant records, in particular those referred to above in the preceding paragraphs and the grounds stated in the RP/1612/2025 and connected Page 24 of 29 ' memorandum of the Revision Petition challenging the orders of the State Commission. These grounds as contained in RP/1612/2025 are reproduced below:
A BECAUSE the Hon'ble State Commission, in Paragraph 16 of the Impugned Order, erred in law and on facts by wrongly holding that the Petitioner Bank made contradictory statements in its Letter dated 11.09.2008. The Petitioner had, in one context, submitted a specific list of 27 farmers found ineligible due to the age barrier, and in a separate context, explained the bona fide administrative difficulties in verifying age records in rural areas. Both statements were rendered in distinct contexts and could not have been compared to infer inconsistency.
B. BECAUSE the Hon'ble State Commission wrongly posed a rhetorical question as to why insurance was processed if certain farmers had crossed 59 years, without appreciating that the farmers lacking age records and those specifically identified as ineligible were not necessarily the same group. The observations were based on a misreading of the Petitioner's submissions.
C. BECAUSE in Paragraph 19 of the Impugned Order, the Hon'ble State Commission misinterpreted the findings of Paragraph 13 of the Learned District Forum's Order. The reference to the Complainant's "failure to challenge" pertained to the Bank's determination of ineligibility, and not to the denial of claim by Respondent No. 2 Insurance Company. The finding of contradiction is therefore erroneous.RP/1612/2025 and connected Page 25 of 29
D. BECAUSE despite observing in Paragraph 18 that the Petitioner had duly submitted all claims to Respondent No. 2, the Hon'ble State Commission failed to appreciate that privity of contract of insurance exists between the Respondents inter se. The Petitioner Bank neither received consideration nor entered into any contract of insurance. In absence of consideration, no liability can be fastened upon the Petitioner.
E. BECAUSE the Petitioner Bank acted merely as an intermediary for collection and remittance of premium, which fact is undisputed. There is no finding of deficiency in service against the Petitioner, yet joint and several liability has been imposed without any adverse reasoning, which is unsustainable in law.
F. BECAUSE the Hon'ble State Commission wrongly interfered with the well-reasoned findings of the Learned District Forum that insurance claims are not payable where the age of the farmer falls outside the covered bracket of 18-59 years, thereby awarding compensation beyond the terms of the Scheme.
G. BECAUSE the "Krishak Sam uh Bima Yojana" is a Government-introduced Scheme governed by specific guidelines defining the roles of participating entities. Directing the Petitioner Bank to pay compensation from its own funds, especially for ineligible claimants, is ultra vires the Scheme and amounts to unlawful diversion of public funds.
H. BECAUSE the Hon'ble State Commission imposed joint and several liability without recording any finding of deficiency RP/1612/2025 and connected Page 26 of 29 against the Petitioner Bank. The adjudication and settlement of claims is the sole prerogative of Respondent No. 2 Insurer, and such function cannot be attributed to the Petitioner.
I. BECAUSE the Petitioner did not retain any premium nor derive financial benefit from the transaction. Saddling the Petitioner with liability results in unjust enrichment of the claimant at the expense of a public bank, contrary to settled principles of equity and the Consumer Protection Act, 2019.
J. BECAUSE having accepted that premiums for 9,436 farmers were duly collected and remitted, the Hon'ble State Commission ought to have held that the Petitioner had fully discharged its duty. Any dispute regarding eligibility is a matter between the Nominee and the Insurer, in which the Petitioner has no locus.
K. BECAUSE the Complaint was filed after a delay of 33 months, and the Hon'ble State Commission granted relief without proper examination of "sufficient cause'' under Section 69 of the Consumer Protection Act, 2019 (corresponding to Section 24A of the 1986 Act), thereby entertaining a stale claim in contravention of statutory mandate.
Similar grounds have been raised in other cases.

After careful consideration of the entire facts and circumstances of the case it is evident that the petitioner bank without doing any verification of the age of the concerned loanee farmers/complainants, which was the main eligibility condition under the master insurance policy between the bank and the insurance company, deducted the premium from the loanee farmers' accounts and remitted the same to the insurance company and RP/1612/2025 and connected Page 27 of 29 ' hence they got covered under the scheme. It is only after the death of these insured farmers, when their claims have not been accepted, that the bank is now taking a stand that they did not fulfil the age condition being above 59 years. Letter dated 28.08.2008/11.09.2008 cited above is a clear admission of the mistake on the part of the bank which they have termed as oversight which clearly amounts to deficiency in service on the part of the petitioner herein.

The District Commission without going through the correct facts of the case wrongly observed in para 13 of its order that the bank did not forward the claim of these 26 complainants to the insurance company because they were deemed ineligible, while it is admitted by the bank that the premium was indeed deducted and claims were forwarded to the insurance company with respect to these 26 farmers. Hence the State Commission rightly came to a finding that the District Commission order/observations in this para are unsustainable.
14. The State Commission has passed a well-reasoned order. We do not find any reason to interfere with its findings. As has been held by the Hon'ble Supreme Court in catena of judgments1 that revisional jurisdiction of the National Commission is extremely limited, it should be exercised only in cases as contemplated within the parameters specified in the provision i.e. when State Commission had exercised a jurisdiction not vested in it by law or had failed to exercise jurisdiction so vested or had acted in the exercise of its jurisdiction so vested or had acted in the exercise of its jurisdiction illegally or with material irregularity. It is only when such findings are found to be against any provisions of law or against 1 Ruby (Chandra) Dutta vs. United India Insurance Co. Ltd. Gold Rush Sales and Services Limited and Anr. (2022) 9 SCC 31 RP/1612/2025 and connected Page 28 of 29 the pleadings or evidence or are found to be wholly perverse, a case for interference may call for at the second appellate (revisional) jurisdiction.

These are the cases where prima facie we also hold that there was a deficiency of service on the part of the petitioner bank herein in deducting the premium from the accounts of the farmers and remitting it to the insurance company which now they claim were not eligible for coverage under the said scheme.
16. Hence we find no illegality or material irregularity in the State Commission order. Accordingly, the impugned order dated 07.10.2024 is upheld and all the 26 Revision Petitions covered under this order are dismissed.
