 2/30 .07.2014                  Both the bail applications are heard together, as they
                  arose from same first information report.
                                Bail applications filed by Santosh Lohra (petitioner in B.A.
                  No. 4886 of 2014) and Mahesh Yadav (petitioner in B.A. No. 4948 of
                  2014) are moved by Sri Jitendra S.Singh, learned counsel for the
                  petitioners and opposed by Sri Pramod Kumar Choudhary and Sri P.K.
                  Appu, learned Additional PPs for the State.
                                This is a case under Sections 413/414/34 of the Indian
                  Penal Code. It is submitted that petitioners have no criminal
                  antecedent, thus, offence under Section 413 of the Indian Penal Code
                  is not made out. It is then submitted that offences under Sections
                  414/34 of the Indian Penal Code is triable by the Court of Magistrate
                  and petitioner namely Santosh Lohra is in custody from 01.05.2014,
                  whereas, petitioner namely Mahesh Yadav is in custody from
                  19.05.2014

.

Learned Additional PPs after going through the case diary has fairly stated that petitioners have no criminal antecedent.

Considering the aforesaid facts and circumstance, I allow these applications and direct the court below to enlarge the petitioners, above named, on bail on their furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Latehar in connection with Chandwa P.S. Case No. 42 of 2014, corresponding to G.R. No. 276 of 2014.
