2. In these matters, the sentences awarded to certain Appellants have been suspended by this Court. The details of the said appeals and corresponding orders are as under:
(i) Crl.A.441/2020 titled Manju Devi vs. State: sentence suspended vide order dated 7th April, 2025;
(ii) Crl.A.575/2020 titled Hema Masih vs. The State: sentence suspended vide order dated 28th May, 2025;
(iii) Crl.A. 10/2021 titled Neha Kumari vs. State (CBI, SPE, SCB, Patna Bihar): sentence suspended vide order dated 29th April, 2025.
3. On the last date of hearing i.e., 16th January, 2026, the interim suspension granted to the Appellants in the above appeals was extended till today.
4. Today, Ms. Manju Devi, Ms. Hema Masih & Ms. Neha Kumari have appeared before the Court virtually.

5. Accordingly, the interim suspension granted to the concerned Appellants- Ms. Manju Devi, Ms. Hema Masih & Ms. Neha Kumari shall continue till the next date of hearing on the same terms, as per the respective orders mentioned above.
6. Insofar as Crl. A. 629/2020, is concerned, Mr. Rajesh Kumar, ld. SPP states that the Appellant-Ms. Chanda Devi has expired on 11th December, 2025.
7. The said fact has also been verified through the verification report filed by Shri. Pawan Kumar Srivastava, Additional Superintendent of Police, CBI, SCB, Patna. The verification report is taken on record.
8. In view of the fact that the said Appellant has passed away, the appeal of Ms. Chanda Devi i.e, Crl. A. 629/2020 stands abated. The said appeal is, accordingly, disposed of.
9. In CRL.A. 508/2020, the Appellant- Ashwani Kumar was convicted for offences under Sections 376(2)/120B/354/109 of the Indian Penal Code and Sections 6/10/12/19/21 of the Protection of Children from Sexual Offences Act, 2012 and was sentenced vide order on sentence dated 1st February, 2020, to rigorous imprisonment for a period of ten years in the following terms:
"21.1: Mr. Prakash Kashyap, Ld. Counsel for Convict No. 18 - Aswini @ Asmani has argued that the convict has no previous criminal record and he has exhibited exemplary conduct during the period of his incarceration and in the event a reduced sentence is imposed on him, in all possibility he would come out of jail and reform himself into a respectable and law abiding citizen in the society. It has further been submitted that the convict belongs to the poor strata of the society and he is the sole bread earner of his family CRL.A. 364/2020 & connected matters Page 7 of 15 This is a digitally signed order.

Counsel for the convict has therefore prayed that keeping in view the entire facts and circumstances of the case a lenient view may be taken against Convict No. 18 Aswini @ Asmani.
21.2: Adverting to the facts of the present case, it is true that convict Aswini @ Asmani was merely an associate of the main accused Brajesh Kumar Thakur and he belongs to the poor strata of the society. It is further seen that he had not committed rape upon any victim girl. It is further seen that he had not physically assisted any other accused person in committing rape upon any of the other victim girls and on that count some leniency can be shown to him 21.3: Considering the facts and circumstances and for the reasons stated hereinabove, the ends of justice would be met if the Convict No. 18 Aswini @ Asmani is sentenced as under:
Charge No.5:
21.3.1: Convict Aswini @ Asmani is sentenced to undergo rigorous imprisonment for a period of "Ten years", for the commission of the offence punishable under section 376(2) read with section 109 of the Indian Penal Code qua the victim girls, in respect of whom charges of rape have been proved, and to fine of Rs. 10,000/- (Rupees Ten Thousand). In the event of his failure to pay the said fine amount, the convict Aswini @ Asmani shall further undergo simple imprisonment for a period of 01 (One) month.
Charge No.4:
21.3.2: The convict Aswini @ Asmani has been sentenced for the offence under section 376(2) read with section 109 of the Indian Penal Code (which is punishable with more stringent punishment) and therefore no separate sentence is being awarded to him for the offence punishable under section 6 read with section 17 of the POCSO Act 2012, qua victim girls, in respect of whom charges of aggravated penetrative CRL.A. 364/2020 & connected matters Page 8 of 15 This is a digitally signed order.

Charge No.6:
21.3.3: Convict Aswini @ Asmani is sentenced to undergo rigorous imprisonment for a period of "Six Months" for the commission of the offence punishable under section 21 (1) read with section 19 of the POCSO Act 2012, and to fine of Rs.10,000/- (Rupees Ten Thousand). In the event of his failure to pay the said fine amount, the convict Aswini @ Asmani shall further undergo simple imprisonment for a period of 01 (One) month. Charge No. 12: 21.3.4: Convict Aswini @ Asmani is sentenced to undergo rigorous imprisonment for a period of "Ten years", for the commission of the offence punishable under section 120-B of the Indian Penal Code read with sections 376(2)/354 of the said Code and sections 6/10 /12 of the POCSO Act 2012, and to fine of Rs.10,000/- (Rupees Ten Thousand). In the event of his failure to pay the said fine amount, the convict Aswini @ Asmani shall further undergo simple imprisonment for a period of 01 (One) month."
10. During the pendency of the appeal, the sentence of the Appellant was suspended vide order dated 31st July, 2025 in the following terms:
"1. This hearing has been done through hybrid mode.
CRL.M.(BAIL) 556/2024
2. The present application has been filed by the Appellant under Section 389 Cr.P.C. read with Section 482 Cr.P.C. seeking regular suspension of sentence and release of the Appellant on bail during the pendency of the present appeal.
3. Ld. Counsel for the Appellant submits that the Appellant was convicted for offences under Sections 376(2)/120B/354/109 of the Indian Penal Code and CRL.A. 364/2020 & connected matters Page 9 of 15 This is a digitally signed order.

It is also submitted that the Appellant has already undergone more than 8 years.
4. The Court has perused the nominal roll dated 2nd May, 2025 which shows that the period undergone including as an under trial as on 30th April, 2025, is 6 years, 4 months and 25 days. In addition, the Appellant has earned remission of 1 year, 3 months and 9 days. Thus, as on 30th April, 2025, the unexpired portion of the sentence is only 2 years, 3 months and 26 days. Accordingly, as on date, therefore, the approximate unexpired portion of the sentence would be only 2 years.
5. Considering that the appeals are presently being heard and some other co-accused have also been granted interim suspension of sentence, it is deemed appropriate to grant interim suspension of sentence to the Appellant till the next date of hearing on his furnishing a personal bond of Rs. 10,000/- with one surety of like amount, to the satisfaction of the ld. Trial Court/Link Court, further subject to the following conditions:
i. The Appellant shall not leave the country without prior permission of this Court; ii. The Appellant shall report to the concerned S.H.O., P.S. Town, Muzaffarpur, Bihar once every month, i.e., the first Monday at 11:00 a.m. and the concerned officer is directed to release him by 12:00 PM after recording his presence and completion of all the necessary formalities; iii. The Appellant shall intimate this Court, by way of an affidavit, as also the concerned Investigating Officer regarding any change in the residential address;
iv. The Appellant shall appear before this Court as and when the matter is taken up for hearing either virtually or physically; and CRL.A. 364/2020 & connected matters Page 10 of 15 This is a digitally signed order.

11. Ld. Counsel for the Appellant, however, submits that the Appellant has not been released on bail, despite the said order of suspension, as he is unable to furnish any surety bond and none of his family members have come forward for the same.
12. The Court has also considered the nominal roll on record of the Appellant in this matter, which shows that the Appellant has served more than 7 years in custody and has earned more than 1 years and 3 months of remission as well.
13. Thus, out of the total sentence of 10 years, he has suffered incarceration of more than 8 years.
14. Under these circumstances, the Court deems it appropriate to issue production warrants for producing the Appellant on the next date before this Court.
15. Let the latest nominal roll of the Appellant be requisitioned in this matter from the concerned Jail Superintendent.
16. Copy of this order be sent to the Jail concerned Superintendent for producing the Appellant on the next date of hearing.
17. In CRL.A. 29/2021, ld. Counsel for the Appellant- Ramashankar Singh submits that the sentence awarded in this matter to the Appellant vide order CRL.A. 364/2020 & connected matters Page 11 of 15 This is a digitally signed order.

18. Under these circumstances, production warrants be issued for producing the Appellant before this Court on the next date of hearing.

CRL.M.(BAIL) 106/2026 in CRL.A. 524/2020
22. This is an application filed by the Appellant- Mr. Vijay Kumar Tiwari under Section 430 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter, 'BNSS') read with Section 528 of the BNSS, inter alia, seeking interim suspension of sentence for a period of three months.
23. The ground for claiming suspension for a period of three months is due to the illness of the Appellant's son who has suffered paralysis due to some injuries. The medical prescriptions of the Appellant's son are also attached with the application.
24. On the last date i.e. 16th January, 2026, notice was issued to ld. Counsel for the CBI, who was directed to verify the facts stated in the application and for filing of the report in respect thereof.
25. Today, Mr. Rajesh Kumar, ld. SPP for the CBI has filed a status report in this regard. The same is taken on record. Mr. Kumar, ld. SPP submits that the local doctor at the Rivet Emergency Hospital, Chiknauta Chowk, Vaishali, Muzaffarpur, has referred the case of the Appellant's son to the Neuro Surgery Department, AIIMS, New Delhi.

26. Mr. Naveen Kumar, PC, CBI, ACB, Patna, visited Muzaffarpur to verify the condition of the son of the Appellant. It was seen that the son of the Appellant- Mr. Manish Kumar Tewari was unable to walk.
27. Further, the Sarpanch of the village Chhitrauli, Muzaffarpur, has also provided a certificate regarding the medical condition of the son of the Appellant. The medical records have also been verified by the CBI.
28. It is further stated that the Appellant's other family members consist of two daughters. Hence, he is the only family member who can take care of his son.
29. The present appeal is part of the Muzaffarpur Shelter Home cases which are a batch of matters presently part heard before this Bench. The arguments in the appeals are going on.
30. The Appellant in the present case has been convicted under Section 376(2)/376D/120B/109 of the Indian Penal Code, Sections 6/10/12/21(1) read with Section 19 of the Protection of Children from Sexual Offences Act, 2012. The Appellant has been sentenced to rigorous imprisonment for the remainder of his natural life.
31. The Court has considered the medical documents attached with the status report which shows the CT Scan of the brain of the Appellant's son. The same reveals certain injuries and the documents including the prescriptions issued have been placed along with the status report.
32. The Court has also considered the latest nominal roll of the Appellant, which shows that the Appellant has been in custody for more than 9 years, including the period of remission.
33. It is noted that the Appellant had also been released on interim bail on an earlier occasion and there has been no misuse of the same. His jail conduct CRL.A. 364/2020 & connected matters Page 13 of 15 This is a digitally signed order.

34. Considering the above, on medical grounds of the son of the Appellant, the Appellant is granted interim suspension of sentence and he be released on interim bail for a period of three months from the date of his release, subject to the following conditions:
(i) The Appellant shall be released upon furnishing a personal bond for a sum of Rs.10,000/-, with a surety of the like amount, to the satisfaction of the Trial Court/Link Court;
(ii) The Appellant is free to travel between Delhi, Patna and Muzaffarpur for seeking his son's medical treatment.
(iii) The Appellant shall intimate the concerned Investigating Officer of his address in Delhi, Patna and Muzaffarpur, and also when he leaves Delhi. The Appellant shall keep him informed about his location from time to time.
(iv) The Appellant shall stay in regular touch with the Investigating Officer.
(v) Whenever he is located in Delhi, Patna or Muzaffarpur, he shall report to the CBI officer in Delhi, Patna or Muzaffarpur on the 1st and 15th of each month at 11:00 AM and shall be allowed to leave within one hour, after recording his presence and completion of necessary formalities.
(vi) The Appellant shall provide his mobile number to the concerned Investigating Officer and keep it operational at all times so that the Investigating Officer can contact him and ascertain his location.
The Appellant shall also inform the concerned Investigating Officer about any change in his mobile number.

(vii) The Appellant shall not leave the country without prior permission of this Court.
(viii) The Appellant shall intimate this Court, by way of an affidavit, as also the concerned Investigating Officer regarding any change in the residential address in Patna, Muzaffarpur and Delhi.
(ix) The Appellant shall appear before this Court as and when the matter is taken up for hearing either virtually or physically.
35. The Appellant shall surrender before the concerned Jail Superintendent immediately upon expiry of the interim bail period.
36. Copy of the order be communicated to the concerned Jail Superintendent for necessary information and compliance.
37. The order be uploaded on the website of this Court forthwith.
