                                  ORDER

Allegation in this letter, which has been treated as an application, is that Vartika Chemical & Pharmaceuticals Pvt. Ltd, G- 1/567, RIICO Indl. Area, Khushkhera, Bhiwadi, District Alwar, Rajasthan is emitting hazardous gases and polluting the environment, untreated effluents are being discharged into the soil and in the sewers then in the rivers. Remedial action is required against the air and water pollution caused by the industry.

The above issue was subject matter of Original Application No. 615 of 2018, Rajiv Yadav Banwal Vs. Vartika Chemicals & Pharmaceuticals Pvt. Ltd. After considering the report from the Central Pollution Control Board and noticing the steps taken to comply with the norms, the application was disposed of on 17.12.2018. This letter appears to have been written before the above order.

In view of the above, no further order is necessary. However the Rajasthan State Pollution Control (State PCB) may continue to monitor the ground situation.

A copy of this order, along with complaint, be sent to the State PCB by e-mail for compliance.

Needless to say that order of National Green Tribunal is binding as a decree of Court and non-compliance is actionable by way of punitive action including prosecution, in terms of the National Green Tribunal Act, 2010.

The application is disposed of.
