Section 625A in The Orissa Estates Abolition Rules, 1952

625A.

(1)Where the Compensation is payable as perpetual annuity under Clause (2) of Section 28 of the Act, the Collector shall issue the Perpetual Annuity Payment Order to the person or persons as may be shown in the Compensation Assessment Roll as finally published under Section 33 of the Act after observing all the formalities required under these Rules, and for this purpose, all the forms prescribed for use for payment of compensation under Clause (1) of Section 28 of the Act shall be used with suitable alterations as may be necessary. The alterations so made in the forms shall be duly attested by the person making the entry. A copy of the order shall be endorsed to the Commissioner of Endowments for his information where the order relates to a Hindu Religious Institution of public nature. In case of change of Trustee, the Endowment Commissioner should Promptly report the fact to the Collector and the Treasury Officer concerned as prescribed in Sub-rule (2) below.
(2)The Endowment Commissioner shall on every change of Trustee of an institution in receipt to the perpetual annuity, report promptly to the Collector and the Treasury Officer concerned the date from which the payment to the outgoing Trustee should cease and the new Trustee shall commence. In order to enable the Collector to prepare fresh payment order, necessary particulars of the new Trustee shall be furnished to the Collector by the Endowment Commissioner in the form prescribed in Annexure-'A' to Subsidiary Rule 625 (b) of the Orissa Treasury Code, Volume 1. On receipt of the information, the Collector shall immediately record the fact in Column 11 of the Register of Compensation Annuity Payment Order in O.T.C. Form No. 72 and call for the annuity holders copy of payment order from the outgoing Trustee under intimation to the Accountant-General and the Treasury Officer concerned. At the same time be shall issue a new payment order in Form No. 75 in favour of the new-Trustee after cancelling the previous one. A copy of such payment order shall also be sent to the Accountant-General. On receipt of the intimation either from the Endowment Commissioner or from the Collector, the Treasury officer shall promptly record the fact in the Register of Compensation Payment Order in Form No. O.T.C. 73 and on disburser's copy of the Compensation Payment Order and stop payment. On receipt of fresh payment order he shall operate upon the same in usual manner and return to the previous Payment Order to the Accountant-General duly cancelled for record.
