2. 18.03.2011. Heard the learned counsels for the petitioners and the State.
The petitioners are apprehending their arrest in a case registered under Sections 147, 148, 149, 323, 307, 332, 353, 186, 189, 427, 225, 337, 338 and 188 of the Indian Penal Code and 3(ii)(5) of Damage to Public Property Act.
It is alleged that one candidate for assembly election was arrested while filing his nomination, when, several persons pelted stones. Petitioners were only members of the mob.
It is submitted by the learned 2 counsel for the petitioners that petitioners have no criminal antecedent.
Considering the general nature of allegations against the mob, let the petitioners, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Ara Nawada P.S. Case No. 450 of 2010 on furnishing bail bond of Rs.10,000/-(Ten Thousand)each with two sureties of the like amount each to the satisfaction of the learned C.J.M.,Bhojpur, Ara, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
