Section 248 in The City of Nagpur Corporation Act, 1948

248. Inspection of place for sale of food or drink and seizure of unwholesome articles or utensils found therein.

(1)Any officer of the Corporation duly authorised in this behalf by the [Commissioner] [This word was substituted for the words 'Chief Executive Officer' by Bombay 79 of 1958, Section 3, Schedule.] may enter into and inspect any market, building, shop, stall, or place used for the sale of any animal, food, drink or drug intended for human consumption or medical treatment or for the preparation, manufacture or storage of the same for sale, and may inspect and examine any such animal, food, drink or drug and any utensil or vessel used for preparing, manufacturing or containing any such food, drink or drug.
(2)If any such animal appears to such officer to be diseased, or if any such food, drink or drug appears to him to be unsound, unwholesome or unfit for human consumption or medical treatment, as the case may be, or to be adulterated, or not to fulfil the specified conditions or to be a substitute, or if any such utensil or vessel is of such kind or in such state as to render any food, drink, or drug prepared, manufactured or contained therein unwholesome or unfit for human consumption or medical treatment, he may seize and remove such animal, food, drink, drug, utensil or vessel in order that the same may be dealt with as hereinafter in this Chapter, provided.
(3)The authorised officer may, instead of removing any animal, food, drink, drug, utensil or vessel seized under subsection (2) leave the same in such safe custody as the [Commissioner] [This word was substituted for the words 'Chief Executive Officer' by Bombay 79 of 1958, Section 3, Schedule.] directs in order that it may be dealt with as hereinafter in this Chapter provided; and no person shall remove it from such custody or interfere or tamper with it in any way while it is so detained.
