 HON'BLE SAURABH SHYAM SHAMSHERY, J.

1. Heard Sri Ashok Khare, learned Senior Advocate assisted by Sri Mohd. Yasin, learned counsel for petitioner and Sri D.K. Singh, learned Additional C.S.C. for State.

2. I find merit in argument of learned Senior Advocate that reasons assigned in impugned order for rejection of claim of petitioner for regularization does not appear to be based on record rather it appears to be contrary to record.

3. In view of above, impugned order dated 27.06.2024 is set aside and matter is remitted back to pass a fresh order after taking note of order dated 16.06.1992 whereby petitioner was appointed and thereafter order dated 04.07.1995 whereby petitioner's appointment was approved as well as that at such belated stage when he has worked for more than 3 decades, any unnecessary objection would not be justified and while considering the matter afresh, concerned respondents will take note of judgment of Supreme Court in Radhey Shyam Yadav vs. State of U.P. and others, 2024 INSC 7 as well as retiral benefits of petitioner will also be settled.

4. Writ petition stands disposed of with above observations.
