Civil Writ Petition No. 15408 of 2012 The petitioner after completing his 10+1 class in the academic period 1993-94 had appeared in 10+2 examination in Commerce Stream for the academic year 1994-95. The petitioner got compartment in the subject of Business Statics. He was also issued Detailed Marks Card as per Roll No. 613236. Subsequently, the petitioner took admission in B.Com correspondence at Delhi University.

Civil Writ Petition No. 15408 of 2012 2

In the year 2007, the petitioner took admission in LL.B. at Chaudhary Charan Singh University, Meerut, Uttar Pradesh and completed his LL.B. The petitioner was told to provide migration certificate from Delhi University. While applying for migration, the petitioner lost his original Detailed Marks Card of 10+2 class and, accordingly, approached respondent Board to provide Detailed Marks Card. Despite having approached the Board number of times, the Detailed Marks Card has not been supplied.

During the course of arguments, it transpires that the Board has destroyed the old result on the basis of Regulation 24(2). This may not authorize the Board to destroy the old record but the counsel appearing for the Board states that now all record is being maintained on a computer. Counsel appearing for the Board further states that the Board is ready to issue Pass Certificate for which it has record. This would satisfy the requirement of the petitioner.

The writ petition is, accordingly, disposed of with a direction to the respondent-Board to issue Pass Certificate to the petitioner.
