1. With the consent of learned counsel appearing for the parties, the petitions are heard finally. For the sake of convenience, the documents filed in WPS No.109 of 2015 are referred for adjudication of these petitions.
2. The petitioners have called in question the impugned order dated 20.11.2014 passed by the Collector (Tribal Development Branch), Raigarh and the order dated 07.11.2014, which is a communication from the office of the Commissioner, Department of Scheduled Caste and Scheduled Tribe Development, Government of Chhattisgarh. By these orders, the authorities have directed the Collectors and the Block Education Officers that 43 for the contingency paid employees, who have been recruited in accordance with the Rules namely; Chhattisgarh Workcharged and Contingency Paid Employees Recruitment and Conditions of Service Rules, 1975 (for short 'the Rules, 1975') shall be entitled for salary on the collector rate for a period of 3 years and, thereafter, they shall be paid the revised pay scale in accordance with the Government instructions in this regard.

Undeniably, the Collector (Tribal Development Branch), Raigarh, issued advertisement for filling up 559 Class-IV posts of contingency paid establishment and after duly completed selection process, the petitioners have been appointed on 24.07.2013. In the advertisement as also in the appointment order, it was mentioned that they are appointed in the pay scale of Rs.4750 - 7440 + 1300 Grade Pay or any other pay scale applicable to the post on which appointments have been made.
4. It is the case of the petitioners that subsequent to the orders Annexures P-1 & P-2, the pay scale has been withdrawn and the petitioners are paid on the basis of collector's rate. Learned counsel for the petitioners would strenuously argue that since in the advertisement a particular pay scale was mentioned and the same was made admissible in the appointment order and, in fact, the said pay scale was paid to all the petitioners for a substantial 44 period, reducing the pay scale in view of the orders Annexures P-
1 & P-2 is illegal. They would also submit that under the Rules, 1975 and the Chhattisgarh Workcharged and Contingency Paid Employees Pay Revision Rules, 2009 (for short 'the Rules, 2009'), the petitioners are entitled for the pay scale as mentioned in Schedule - I of the Rules, 2009, therefore, the impugned order/action is illegal. They would next submit that the order has been passed without affording proper opportunity of hearing to the petitioners.

Per contra, learned counsel appearing for the State would refer to the Rules, 1975 and the gazette notifications dated 14.10.1982 and 13.10.1981 (Annexure R-2) to argue that the contingency paid employee is entitled for fixed salary on collector's rate for a period of 3 years and, thereafter, he is treated as temporary member of the service to make him entitled for revised pay scale.
There being an error in the advertisement and the appointment order, which wrongly mentioned that the petitioners are appointed to a particular pay scale, the same is brought to the notice of the appointing authority or the drawing & disbursing officer by Annexures P-1 & P-2. He would further submit that since the petitioners are not entitled for the pay scale unless they complete 3 years service and become temporary member of the 45 contingency paid establishment, the impugned action is fully justified and in accordance with law.
6. Petitioners' services are governed under the Rules, 1975. Rule 4 of the said Rules speaks about constitution of service. Sub-rule (2) says that any person appointed after coming into force of the rules would become a member of the service after putting in 5 years of service. The Rules, 1975 has not made any provision regarding payment of salary on collector's rate or on particular pay scale, therefore, the issue has been dealt with by issuing separate notifications on 14.10.1982 and 13.10.1981 vide Annexure-R-2.
The said notification provides that any person appointed under the Rules, 1975 shall not be a member of contingency/work charge paid establishment for a period of 5 years. On competition of 5 years of service, he shall attain the status of temporary member and on completion of 5 years of service as temporary member, he shall attain the status of permanent member. Clause 6 of the notification provides that any person recruited under the Rules, 1975 shall be placed on collector's rate for a period of 3 years and, thereafter, for the purpose of payment of salary, he shall be treated as temporary member and shall be entitled for revised pay scale on completion of the said period of 3 years.
467. It appears, there was a mistake committed by the Collector, Raigarh, in mentioning a particular pay scale in the advertisement and, thereafter, issuing the appointment order by mentioning the said pay scale. Even though a contingency and work charged paid employee is not treated as a member of service for initial period of 3 years and is not entitled for regular pay during the said period.

Learned counsel for the petitioners have urged that the pay scale has been withdrawn without giving any opportunity of hearing, however, it is to be seen that the petitioners are not entitled for the pay scale under any applicable rules. Therefore, it is not a case, where the pay scale admissible to the petitioners has been withdrawn or reduced.
9. In National Institute of Technology v. U. Dinakar and Another1, it has been held that the competent authority has inherent power to correct the mistake, if any, committed in the order of appointment.
10. In State of Rajasthan v. Kunji Raman2, the Supreme Court has held that the work-charged employees and employees on regular establishment of PWD are two separate and distinct classes.

8. A work-charged establishment thus differs from a regular establishment which is permanent in nature. Setting up and continuance of a work-
charged establishment is dependent upon the Government undertaking a project or a scheme or a 'work' and availability of fund for executing it. So far as employees engaged on work-charged establishments are concerned, not only their recruitment and service conditions but the nature of work and duties to be performed by them are not the same as those of the employees of the regular establishment. A regular establishment and a work-charged establishment are two separate types of establishments and the persons employed on those establishments thus form two separate and distinct classes. For that reason, if a separate set of rules are framed for the persons engaged on the work-charged establishment and the general rules applicable to persons working on the regular establishment are not made applicable to them, it cannot be said that they are treated in an arbitrary and discriminatory manner by the Government. It is well-settled that the Government has the power to frame different rules for different classes of employees. We, therefore, reject the contention raised on behalf of the appellant in Civil Appeal No. 653 of 1993 that Clauses (g), (h) and (i) of Rule of RSR are violative of Articles 14 and 16 of the Constitution and uphold the view taken by the High Court.
11. The Supreme Court in Punjab State Electricity Board and Others v. Jagjiwan Ram and Others3, again emphasised the distinction between the work-charged employee and the regular employee. It is held thus in paras 10 & 14 :

10. The work charged employees can claim protection under the Industrial Disputes Act or the rights flowing from any particular statute but they cannot be treated on a par with the employees of regular establishment. They can neither claim regularization of service as of right nor can they claim pay scales and other financial benefits on a par with regular employees. If the service of a work charged employee is regularized under any statute or a scheme framed by the employer, then he becomes member of regular establishment from the date of regularization. His service in the work charged establishment cannot be clubbed with service in a regular establishment unless a specific provision to that effect is made either in the relevant statute or the scheme of regularization. In other words, if the statute or scheme under which service of work charged employee is regularized does not provide for counting of past service, the work charged employee cannot claim benefit of such service for the purpose of fixation of seniority in the regular cadre, promotion to the higher posts, fixation of pay in the higher scales, grant of increments etc.
14. The ratio of the above mentioned judgments is that work charged employees constitute a distinct class and they cannot be equated with any other category or class of employees much less regular employees and further that the work charged employees are not entitled to the service benefits which are admissible to regular employees under the relevant rules or policy framed by the employer.
12. Similar is the pronouncement by the Supreme court in State of Haryana and Others v. Ravinder Kumar and Other4.

13. It would, thus, be explicit that the work-charged employee is separate and distinct than a regular employee. Their services are governed under the different set of rules and their entitlement of any benefit in the matter of regular scale would be governed by the Rules, 1975. Merely because a particular pay scale was wrongly mentioned in the advertisement or in the letter of appointment, it would not change their status from the category of work-charged employee to a regular employee.
14. In so far as issue concerning recovery is concerned, the Supreme Court after placing reliance upon the decision rendered in Chandi Prasad Uniyal and Others v. State of Uttarakhand and Others5, the Supreme Court in State of Punjab and Others v.
Rafiq Masih (Whitewasher)6, held thus :
"7. In Chandi Prasad Uniyal case, a specific issue was raised and canvassed. The issue was whether the appellant therein can retain the amount received on the basis of irregular/wrong pay fixation in the absence of any misrepresentation or fraud on his part. The Court after taking into consideration the various decisions of this Court had come to the conclusion that even if by mistake of the employer the amount is paid to the employee and on a later date if the employer after proper determination of the same discovers that the excess payment is made by mistake or negligence, the excess payment so made could be recovered. While holding so this Court 5 (2012) 8 SCC 417 6 (2014) 8 SCC 883 50 observed at paras 14 and 16 as under: (SCC p.
423) "14. We are concerned with the excess payment of public money which is often described as 'taxpayers' money' which belongs neither to the officers who have effected overpayment nor to the recipients.
We fail to see why the concept of fraud or misrepresentation is being brought in in such situations. The question to be asked is whether excess money has been paid or not, may be due to a bona fide mistake.
Possibly, effecting excess payment of public money by the government officers may be due to various reasons like negligence, carelessness, collusion, favouritism, etc. because money in such situation does not belong to the payer or the payee. Situations may also arise where both the payer and the payee are at fault, then the mistake is mutual. Payments are being effected in many situations without any authority of law and payments have been received by the recipients also without any authority of law. Any amount paid/received without the authority of law can always be recovered barring few exceptions of extreme hardships but not as a matter of right, in such situations law implies an obligation on the payee to repay the money, otherwise it would amount to unjust enrichment.

16. The appellants in the appeal will not fall in any of these exceptional categories, over and above, there was a stipulation in the fixation order that in the condition of irregular/wrong pay fixation, the institution in which the appellants were working would be responsible for recovery of the amount received in excess from the salary/pension. In such circumstances, we find no reason 51 to interfere with the judgment of the High Court. However, we order that excess payment made be recovered from the appellant's salary in twelve equal monthly instalments........"
15. In the case at hand, there is no order by the drawing & disbursing officer or any other officer against any of the petitioner. Although, it has been stated that the pay scale has been withdrawn, because the petitioners are now placed on collector's rate instead of paying the pay scale, which was paid to them for a substantial period, yet there being no order against any of the petitioners, this Court has no occasion to examine the said issue. In the present cases, this Court was called upon to examine the validity of the orders dated 20.11.2014 and 07.11.2014 and this order shall remain confine to that issue only by holding that those orders have been issued by the authorities perfectly in accordance with the provisions of the Rules, 1975 and the State Government's notification dated 07.03.2012 (Annexure - R/1) and 14-10-1982 & 13-10-1981 (Annexure - R/2).
16. As a sequel, all the writ petitions, sans merit, are liable to be and are hereby dismissed. No order as to costs.
