11/09/2018 Mr. Anil Upman, learned counsel for the petitioner has contended that the petitioner had lodged FIR No.71/2016 for the offences under Sections 323, 341, 354 and 34 IPC against the Asmat Alam. Learned counsel for the petitioner has contended that the investigating agency submitted Final Report in negative form and upon issuance of notice, petitioner filed application Annexure-1 stating therein that in the spirit of Lok Adalat, she do not intend to file protest petition and the matter be decided. She further stated that she has no objection in case Final Report submitted in negative form is accepted by the trial court. Learned counsel for the petitioner has further contended that the petitioner nowhere stated that she had levelled false allegations or she is withdrawing the allegations levelled against the accused. Learned counsel for the petitioner has contended that hence, initiation of proceedings under Section 182 IPC against the petitioner is bad in the eyes of law.
Issue notice to the respondent for 3.12.2018.
(2 of 2) [CRLMP-5315/2018] List this case on 3.12.2018. Meanwhile, further proceedings against the petitioner in court below shall remain stayed.
