1. The issues under consideration arising out of the second appeal dated 07.05.2019include non-receipt of the following information sought by the appellant through the RTI application dated 05.01.2019 and first appeal dated 18.02.2019 :-

(i) Kindly provide certified copy of all the papers/documents, with complete file on the basis of which gold loan was sanctioned to him against A/C No. xxxxx476042925.

2. Succinctly facts of the case are that the appellant filed an application dated 05.01.2019 under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), State Bank of India, Jharkhand, seeking aforesaid information. The CPIO did not give any reply to the appellant. Dissatisfied with the same, the appellant filed first appeal dated 18.02.2019. The First Appellate Authority (FAA) did not pass any order. Aggrieved by the same, the appellant filed a second appeal dated 07.05.2019 before the Commission which is under consideration.

3. The appellant has filed the instant appeal dated 07.05.2019 inter alia on the grounds that no reply was given by the respondent. The appellant requested the Commission to direct the CPIO to provide the complete information and take necessary action as per Section 20 (1) of the RTI Act.

4. Perusal of the records submitted by the appellant while filing the second appeal dated 07.05.2019 reveals that neither the CPIO nor the FAA provided any information or any reply to the appellant.

5. The appellant remained absent and on behalf of the respondent Shri Kaushik Kumar, Regional Manager & CPIO, State Bank of India, Deoghar attended the hearing through video conference.

5.1. The respondent while defending their case inter alia submitted that they had not responded to the RTI application dated 05.01.2019 as they had not received the same. However, they had obtained a copy of the application upon receipt of the hearing notice and requested the Commission to grant them two weeks time to given an appropriate reply to the applicant.

The Commission after adverting to the facts and circumstances of the case, hearing the respondent and perusal of records, observes that the respondent had not replied to the Page 2 of 3 RTI application so far on account of non-receipt of the RTI application. Further, the respondent requested for some time to file their reply. Accordingly, the respondent is directed that appropriate reply/information as per the provisions of the RTI Act be made available to the appellant within three weeks from the date of receipt of this order and a copy of the same along with dispatch proof be uploaded on the Commission's portal. With these observations and directions, the appeal is disposed of.

Copy of the decision be provided free of cost to the parties.
