                                  ORDER

1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO) Reserve Bank of India, Mumbai. The particulars of information sought under are:

2. The CPIO vide letter dated 25-09-2019 has not provided requested information to appellant as the same is not available in their office. Being dissatisfied with the same, the appellant has filed first appeal dated 03-10-2019 and requested that the information should be provided to her. The FAA vide order dated 01-11-2019 upheld CPIO's reply and disposed off the appeal. She has filed a second appeal before the Commission on the ground that information sought has not been provided to her and requested to direct the respondent to provide complete and correct information.

Hearing:

3. Shri Malkhan Singh Parihar (Representative of Appellant) attended the hearing through audio-call. The respondent, Shri Sudip Malik, Representative CPIO/ General Manage along with Ms Ruchita, Legal Consultant attended the hearing through audio-call.

4. The representative of appellant submitted that the relevant documents of the instant matter has been misplaced, therefore he is not aware of the facts of the case. The Commission read out contents of the RTI Application.

5. The respondent has submitted that vide their letter dated 25.09.2019; they have already informed the appellant that the requested information is not available in their office. That the relevant documents as available in the records of the respondent can be provided to the appellant.

Decision:

6. The Commission, after hearing the submissions of both the parties and after perusal of records, observes that the appellant has sought certified copies of the documents conferred through any circular, order or gazette notification of the Govt. of India on the basis of which RBI has been empowered to certify the photocopies of unsigned, unnamed documents and other queries related thereto. That the respondent has informed the Commission that the documents as available in their records can be certified and provided to the appellant.

7. In view of the above, the Commission deems it fit to direct the respondent to authenticate/ certify the relevant documents as sought by the appellant as per the original documents available with the respondent public authority and the Page 2 of 3 same should be provided to the appellant within 15 days from the date of receipt of this order. Further, the Commission admonishes the then CPIO for not providing an appropriate reply to the appellant initially and cautions him to be more careful in future while dealing with the matters related to the RTI Act, 2005.

8. With the above observations, the appeal is disposed of.

9. Copy of the decision be provided free of cost to the parties.
