Petitioner, vice President of Madhya Pradesh Pashu Palan Evam Gau Samvardhan Board, district Datia, vide this Public Interest Litigation alleging embezzlement of money allotted for plantation of "napier grass" under Bundelkhand Project in district Datia seeks direction for an enquiry.
It, however, appears from paragraph 3-D of the petition that the petitioner has personal grievance against the State Government functionaries who have caused an enquiry into the functioning of petitioner's "Gaushala" at Indergarh. In these fact situation the present writ petition cannot be said to be a public 2 interest litigation. Instead under the garb of public interest, petitioner intends to settle his personal interest.
Therefore, the present petition being not a genuine public interest litigation cannot be entertained but deserves to be dismissed. However, with a caveat that the Collector, Datia shall cause an enquiry into working of petitioner's "Gaushalla" at Indergarh and if it is found that the same is not functioning in accordance with statutory norms then take action as per law.
Let a copy of the order be sent to Collector, Datia through Email/Fax for necessary action.
