Adjunct to the captioned order dated 24.6.11
Background
1. The Commission received a petition dt.8.8.11 stating that the decision of the Commission in case No.CIC/AD/A/2011/000940 dt.24.6.11 has not been complied with. The decision is reproduced below:
'The Commission on review of the documents on record noted that the additional photocopying fees has been sought after the prescribed period of one month was over and therefore directs the PIO to provide complete information free of cost as per Section 7(6) of the RTI Act'.
Decision
3. During the hearing, the Complainant submitted that he has yet to receive detailed drawings with metric units in response to his RTI application. The Respondent submitted that the detailed drawings being sought by the Appellant are not available in their records and that all the information as available in their records has been already been furnished to the Appellant. The Appellant however was not willing to accept this explanation of the Respondents.
4. Since the Appellant is refusing to believe the Respondents, the only recourse left is for the PIO to furnish and affidavit to the Commission with a copy to the Appellant affirming his position that information sought(about the drawings) is not available in the records. The affidavit should reach the Commission/Complainant by 20.3.12.
5. The complaint is disposed off with the above directions.
