This order will dispose of two Civil Writ Petitions i.e. Civil Writ Petition No. 4181 of 2005(Kuljinder Kaur and others vs. State of Punjab and others ) and Civil Writ Petition No. 4699 of 2005 (Simerjeet Kaur and others vs. State of Punjab and others) as common question of law arises in these cases. The facts are being taken from C.W.P. No. 4181 of 2005.
This writ petition was ordered to be heard alonwith C.W.P. No. 2166 of 2005 which was disposed of as infructuous on 08.01.2009.
The petitioners took admission with respondent No. 3 College in the first year of three years course of General Nursing Midwifery (GNM). A raid was conducted by the Vigilance Civil Writ Petition No. 4181 of 2005 2 Department, Punjab in the premises of the College on October 2004. The petitioners and some other students were really unahappy with the working of respondent No. 3-College due to various reasons. It is stated that there was no teaching staff, no infrastructure of main building and hospital etc. The students, accordingly, raised protest. It is also alleged that the institution was charging excessive fee, illegal fine and complete deficiency in service in imparting the education for GNM course. Some of the petitioners and other students gave a complaint to respondent No. 2 and prayed for their migration to some other Nursing Institute. Respondents No. 1 and 2 inspected premises of the College and submitted their report. Respondent No. 1 recommended various actions and directed for fixing responsibility of various officials with whose collusion respondent No. 3 was getting clearance or affiliation of respondent No. 3-Institute.
The petitioners and some other students were not allowed to join classes w.e.f. 18.12.2004. They complained against the same and staged a protest on 03.01.2005. Respondent No. 2 issued a show cause notice to respondent No. 3 wherein all the aforementioned irregularities committed by respondent No. 3 were pointed out. Despite the same, respondent No. 3 has not taken steps to improve the infrastructure. Accordingly, the petitioners approached this Court through present writ petition for direction to respondent institute to rectify the deficiencies and also to direct refund ten times the fee charged and for closing the institute as such so that the other students did not suffer and with further direction to Civil Writ Petition No. 4181 of 2005 3 transfer the petitioners to some other institutions.
The writ petition was admitted on 16.08.2005 and was ordered to be listed for final disposal within four months. Thereafter, the case has not been listed for hearing. The students who are admitted in the year 2004 would have passed out or would have been adjusted somewhere else. No one otherwise has appeared on behalf of the petitioners.
In view of the nature of relief claimed in the said writ petition and also in view of the fact that with the efflux of time no effective relief can be granted to the petitioner, the present writ petitions apparently are rendered infructuous and are disposed of as such, as was ordered in CWP No. 2166 of 2005 which was disposed of as infructuous on 08.01.2009.
