1. The present C.P. has been filed alleging non compliance of the order dated 16.07.2018 (Annexure C-1) passed by this Court in O.A. No. 060/00833/2017.

2. Pursuant to show cause notice, the respondents have filed reply affidavit, which is taken on record. On the last date of hearing, an argument was raised by the learned counsel for the petitioners that the petitioners have not been paid the salary as per the directions of this Court in the case of Vandana Jain & Others Vs. Union of India and Others (O.A. No. 33/2010 decided on 31.03.2011) i.e. minimum of the pay scale + D.A (enhanced from time to time) from 13.03.2007 till 2016. The respondents, therefore, were directed to file an affidavit clarifying this aspect.

Today, Mr. Gaurav Mohantu, learned counsel for the Chandigarh Administration, has filed an affidavit of Rupinder Singh Brar, Director School Education, Chandigarh Administration, stating therein that the consolidated salary being paid to the petitioners is sum of salary and D.A.(as enhanced from time to time), as directed by this Court in the case of Vandana Jain (supra). He, therefore, prays that this C.P., in view of the above factual position, may be closed.
4. We have given our thoughtful consideration to the matter.

In the affidavit filed by the Competent Authority of the Chandigarh Administration it has been specifically stated, while giving all the details of basic pay and D.A. as revised from time to time, that the petitioners are being paid consolidated salary which is actually the sum of minimum of basic pay of the post and D.A. (as revised from time to time). Therefore, we are satisfied that the respondents are paying the petitioners salary as held by this Court in the case of Vandana Jain (supra).

6. In view of the above, no case for contempt against the respondents is made out and therefore, the CP is closed. Notices stand discharged.
