                                    ORDER

1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO) Bharat Petroleum Corporation Limited, Territory Manger (LPG), Territory Office & Bharat Gas Plant, Jaipur, S P -II Road No. 14, Viswakarma Industrial Area, Jaipur. The appellant seeking information on three points, including, inter-alia:-

(i) When the gas connection was issued by Aarav Gas Agency who is the distributor of Super Gas which is operated by BPCL to the Bajraj Hotel along with copy of order for the gas connection issued;

(ii) Number of cylinders issued till date, etc. Page 1 of 3

2. As the CPIO had not provided the requested information, the appellant filed the first appeal dated 22.10.2018 requesting that the information should be provided to him. The first appellate authority was ordered on 30.10.2018 and disposed of his first appeal. He filed a second appeal u/Section 19(3) of the RTI Act before the Commission on the ground that information has not been provided to him and requested the Commission to direct the respondent to provide complete and correct information.

Hearing:

3. The appellant attended the hearing through audio-call. The respondent, Shri Kishore Latkar, CPIO attended the hearing through audio-call.

4. The respondent submitted their written submissions dated 09.10.2020 and the same has been taken on record.

5. The appellant submitted that wrong information has been provided to him by the respondent on his RTI application dated 17.09.2018.

6. The respondent submitted that vide their letter dated 12.10.2018, point-wise reply/information has already been provided to the appellant on his RTI application dated 17.09.2018. The reply was seen during the hearing.

Decision:

7. The Commission, after hearing the submissions of both the parties and after perusal of records, observes that the respondent has not given proper information on point no. 1, 2 and 3 of the RTI application dated 17.09.2018. It seems that the respondent has not properly read the query at point no. 1 and has omitted the name of gas agency. In view of this, the Commission directs the respondent to re-examine the RTI application dated 17.09.2018 of the appellant and give revised point-wise reply/information as per the provisions of the RTI Act, within a period of 15 working days from the date of receipt of this order.

8. With the above observations, the appeal is disposed of.
